Hadith 2311
أَخْبَرَنَا
مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا
سُفْيَانُ، عَنْ
سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ
الشَّعْبِيِّ، عَنْ
فَاطِمَةَ بِنْتِ قَيْسٍ:
"أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَفَقَةً وَلَا سُكْنَى" . قَالَ سَلَمَةُ: فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ، فَقَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ: لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّهِ بِقَوْلِ امْرَأَةٍ، فَجَعَلَ لَهَا السُّكْنَى وَالنَّفَقَةَ.
It is narrated from Sayyida Fatimah bint Qais (may Allah be pleased with her) that her husband gave her three divorces, and the Noble Prophet (peace and blessings be upon him) did not provide her with housing nor maintenance. Muslimah said: I mentioned this to Ibrahim, so he said: Sayyiduna Umar ibn al-Khattab (may Allah be pleased with him) said: Shall we abandon the Book of our Lord and the Sunnah of His Messenger because of what a woman says? No, so he prescribed housing and maintenance for a divorced woman.
Hadith 2312
أَخْبَرَنَا
يَعْلَى، حَدَّثَنَا
زَكَرِيَّا، عَنْ
عَامِرٍ، حَدَّثَتْنِي
فَاطِمَةُ بِنْتُ قَيْسٍ: "أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا،
فَأَمَرَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ تَعْتَدَّ عِنْدَ ابْنِ عَمِّهَا ابْنِ أُمِّ مَكْتُومٍ".
Lady Fatimah bint Qais (may Allah be pleased with her) narrated that her husband gave her a third divorce, so the Messenger of Allah (peace and blessings be upon him) ordered her to spend her waiting period in the house of her paternal cousin (Abdullah) bin Umm Maktum.
Hadith 2313
Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him) said: Shall we leave the Book of our Lord and the Sunnah of His Prophet because of what a woman says? No, for a woman who has been given three divorces, there is both residence and maintenance for her.
Hadith 2314
A narration similar to the previous one is reported from Sayyiduna Umar (may Allah be pleased with him).
Hadith 2315
It is narrated from Aswad that Amir al-Mu'minin Sayyiduna Umar (may Allah be pleased with him) said: We will not accept the word of any woman in the religion of Allah. For a woman who has been given three divorces, there is both residence and maintenance.
Imam Darimi (may Allah have mercy on him) said: In my view, for such a divorced woman, there is neither residence nor maintenance.
