Hadith 2299
أَخْبَرَنَا
خَالِدُ بْنُ مَخْلَدٍ، حَدَّثَنَا
مَالِكٌ، عَنْ
نَافِعٍ، عَنِ
ابْنِ عُمَرَ: أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ:
"مُرْهُ أَنْ يُرَاجِعَهَا وَيُمْسِكَهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضُ، ثُمَّ تَطْهُرُ، ثُمَّ إِنْ شَاءَ، أَمْسَكَ، وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ".
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that he divorced his wife while she was in her menstrual period. Sayyiduna Umar (may Allah be pleased with him) mentioned this to the Noble Prophet (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) said: "Tell him to take her back and keep her with him until she becomes pure, then her menstrual period comes again and then she becomes pure again. Then, if he wishes, he may keep her with him, and if he wishes, he may divorce her before having intercourse with her. This is the waiting period (iddah) which Allah the Exalted has commanded that women should be divorced in." (That is, this is the period which Allah the Exalted has commanded in «فطلقوهن لعدتهن».)
Hadith 2300
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that when he divorced his wife, Sayyiduna Umar (may Allah be pleased with him) mentioned this to the Noble Prophet (peace and blessings of Allah be upon him). He (peace be upon him) said: "Tell him to take his wife back (i.e., to revoke the divorce), then if he wishes, he may divorce her while she is in a state of purity." Imam Darimi (may Allah have mercy on him) said: Ibn al-Mubarak and Waki‘ narrated that it was in the state of pregnancy. (That is, either divorce her in a state of purity, or if the woman is pregnant, then divorce her at that time.)
