باب في أَكْلِ لَحْمِ الصَّيْدِ لِلْمُحْرِمِ إِذَا لَمْ يَصِدْ هُوَ:
Chapter: Eating Game Meat Not Hunted by the Pilgrim
Hadith 1864
أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا هِشَامٌ الدَّسْتَوَائِيُّ، عَنْ يَحْيَى، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي قَتَادَةَ، قَالَ: انْطَلَقَ أَبِي مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ الْحُدَيْبِيَةِ، فَأَحْرَمَ أَصْحَابُهُ وَلَمْ يُحْرِمْ أَبُو قَتَادَةَ، فَأَصَابَ حِمَارَ وَحْشٍ، فَطَعَنَهُ وَأَكَلَ مِنْ لَحْمِهِ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، إِنِّي أَصَبْتُ حِمَارَ وَحْشٍ، فَطَعَنْتُهُ، فَقَالَ لِلْقَوْمِ: "كُلُوا"وَهُمْ مُحْرِمُونَ.
Abdullah bin Abi Qatadah narrated that my father went out with the Messenger of Allah (peace be upon him) at the time of the Treaty of Hudaybiyyah (and went ahead to scout the enemy), his companions had entered into the state of Ihram, but Abu Qatadah (may Allah be pleased with him) had not entered into Ihram. He saw a wild donkey, hunted it with a spear, and ate its meat. He said: Then I submitted: O Messenger of Allah! I saw a wild donkey and hunted it by throwing a spear or an arrow at it. The Messenger of Allah (peace be upon him) said to the companions: "Eat," and all of them were in the state of Ihram.
Hadith 1865
أَخْبَرَنَا أَبُو الْوَلِيدِ، حَدَّثَنَا شُعْبَةُ، عَنْ عُثْمَانَ بْنِ عَبْدِ اللَّهِ بْنِ مَوْهَبٍ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي قَتَادَةَ، عَنْ أَبِيهِ، قَالَ: بَيْنَمَا نَحْنُ نَسِيرُ وَهُمْ مُحْرِمُونَ، وَأَبُو قَتَادَةَ حَلَالٌ، إِذْ رَأَيْتُ حِمَارًا، فَرَكِبْتُ فَرَسًا، فَأَصَبْتُهُ، فَأَكَلُوا مِنْ لَحْمِهِ وَهُمْ مُحْرِمُونَ وَلَمْ آكُلْ، فَأَتَوْا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلُوهُ، فَقَالَ: "أَشَرْتُمْ، قَتَلْتُمْ ؟ أَوْ قَالَ: ضَرَبْتُمْ ؟ قَالُوا: لَا، قَالَ: فَكُلُوا".
Sayyiduna Abu Qatadah Ansari (may Allah be pleased with him) said: Our caravan was traveling in the state of Ihram, and I (Abu Qatadah, may Allah be pleased with him) was not in Ihram, when suddenly I saw a wild donkey. I mounted my horse and hunted it. My companions ate its meat while they were in the state of Ihram, and I did not eat. When they reached the Messenger of Allah (peace and blessings be upon him), they asked him (about this matter). The Messenger of Allah (peace and blessings be upon him) inquired: "Did you signal to it? Did you hunt it?" or he said, "Did you kill it?" They replied: No. The Prophet (peace and blessings be upon him) said: "Then eat it."
Hadith 1866
أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ صَالِحِ بْنِ كَيْسَانَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، عَنْ ابْنِ عَبَّاسٍ، عَنْ الصَّعْبِ بْنِ جَثَّامَةَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُتِيَ بِلَحْمِ حِمَارِ وَحْشٍ، فَرَدَّهُ وَقَالَ: "إِنَّا حُرُمٌ لَا نَأْكُلُ الصَّيْدَ".
It is narrated from Sayyiduna Sa'b bin Jathamah (may Allah be pleased with him) that wild donkey meat was presented to the Noble Prophet (peace and blessings be upon him), but he (peace be upon him) returned it and said: "We are in the state of Ihram; we cannot eat game."
Hadith 1867
أَخْبَرَنَا أَبُو عَاصِمٍ، عَنْ ابْنِ جُرَيْجٍ، عَنْ ابْنِ الْمُنْكَدِرِ , عَنْ مُعَاذِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عُثْمَانَ التَّيْمِيِّ، عَنْ أَبِيهِ، قَالَ: كُنَّا مَعَ طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ فِي سَفَرٍ، فَأُهْدِيَ لَهُ طَيْرٌ وَهُمْ مُحْرِمُونَ، وَهُوَ رَاقِدٌ، فَمِنَّا مَنْ أَكَلَ، وَمِنَّا مَنْ تَوَرَّعَ، فَاسْتَيْقَظَ طَلْحَةُ فَأَخْبَرُوهُ، فَوَفَّقَ مَنْ أَكَلَهُ، وَقَالَ: "أَكَلْنَاهُ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ".
It is narrated from Mu'adh bin Abdur Rahman bin Uthman Taymi that his father Abdur Rahman said: We were on a journey with Sayyiduna Talhah bin Ubaidullah (may Allah be pleased with him) when a bird was presented to him as a gift, and all of them were in the state of ihram, and Sayyiduna Talhah (may Allah be pleased with him) was sleeping. Some of us ate the meat of that bird and some abstained from it. When Sayyiduna Talhah (may Allah be pleased with him) woke up, the people informed him about it. So Sayyiduna Talhah (may Allah be pleased with him) supported those who had eaten the meat and said: We ate the meat of game with the Messenger of Allah (peace and blessings be upon him).
Hadith 1868
أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا ابْنُ عُيَيْنَةَ، عَنْ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، عَنْ ابْنِ عَبَّاسٍ، قَالَ: حَدَّثَنِي الصَّعْبُ بْنُ جَثَّامَةَ، قَالَ: مَرَّ بِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَنَا بِالْأَبْوَاءِ أَوْ بِوَدَّانَ، فَأَهْدَيْتُ لَهُ لَحْمَ حِمَارِ وَحْشٍ، فَرَدَّهُ عَلَيَّ، فَلَمَّا رَأَى فِي وَجْهِي الْكَرَاهِيَةَ، قَالَ: "إِنَّهُ لَيْسَ بِنَا رَدٌّ عَلَيْكَ، وَلَكِنَّا حُرُمٌ".
Sayyiduna Sa'b bin Jathamah (may Allah be pleased with him) said: The Noble Prophet (peace and blessings be upon him) passed by me at the place of Abwa or Waddan, so I presented him with the meat of a wild donkey, but he returned it to me. When he saw sadness on my face, he said: "We did not need to return it, but at this time we are in the state of Ihram."
