باب اسْتِبْرَاءِ الأَمَةِ:
Chapter: Ensuring a Slave Woman is Not Pregnant
Hadith 1211
أَخْبَرَنَا يَزِيدُ، حَدَّثَنَا شَرِيكٌ، عَنْ لَيْثٍ، عَنْ طَاوُسٍ، فِي اسْتِبْرَاءِ الْأَمَةِ إِنْ لَمْ تَكُنْ تَحِيضُ، قَالَ: "خَمْسَةً وَأَرْبَعِينَ".
It is narrated from Tawus, may Allah have mercy on him, that if a slave girl does not menstruate, then her waiting period for Istibra is forty-five (45) days.
Hadith 1212
أَخْبَرَنَا يَزِيدُ، أَخْبَرَنَا شَرِيكٌ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنْ أَبِي قِلَابَةَ، قَالَ: "ثَلَاثَةُ أَشْهُرٍ".
Abu Qilabah (may Allah have mercy on him) said: Its period is three months.
Hadith 1213
أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ، عَنْ عُمَرَ بْنِ عَبْدِ الْوَاحِدِ، عَنْ الْأَوْزَاعِيِّ، قَالَ: سَأَلْت الزُّهْرِيَّ عَنْ الرَّجُلِ يَبْتَاعُ الْجَارِيَةَ لَا تَبْلُغْ الْمَحِيضَ وَلَا تَحْمِلُ مِثْلُهَا، كَمْ يَسْتَبْرِئُهَا ؟، قَالَ: "ثَلَاثَةَ أَشْهُرٍ".
It is narrated from Imam Awza'i, may Allah have mercy on him, that I asked Imam Zuhri, may Allah have mercy on him, if a man buys a minor slave girl who has neither menstruated nor is capable of becoming pregnant like those of her age, what will be the duration of her 'istibra' (waiting period)? He replied: Three months.
Hadith 1214
وقَالَ يَحْيَى بْنُ أَبِي كَثِيرٍ: "بِخَمْسَةٍ وَأَرْبَعِينَ يَوْمًا".
Yahya bin Abi Kathir has stated the period of Istibra’ (waiting period) for a slave woman to be 45 days.
Hadith 1215
أَخْبَرَنَا الْهَيْثَمُ بْنُ جَمِيلٍ، عَنْ ابْنِ الْمُبَارَكِ، عَنْ يَحْيَى بْنِ بِشْرٍ، عَنْ عِكْرِمَةَ، قَالَ: "بِشَهْرٍ"، سُئِلَ عَبْد اللَّهِ: بِأَيِّهِمَا تَقُولُ ؟، قَالَ: "ثَلَاثَةُ أَشْهُرٍ أَوْثَقُ، وَشَهْرٌ يَكْفِي".
It is narrated from Yahya bin Bishr, Ikrimah (may Allah have mercy on him) said: (Its duration) is one month. Imam Darimi (may Allah have mercy on him) was asked: What is your opinion? He replied: Three months is a precautionary strong duration, and one month is also sufficient.
