Hadith 1209
أَخْبَرَنَا مُحَمَّدُ بْنُ يَزِيدَ، حَدَّثَنَا ضَمْرَةُ، قَالَ: حَدَّثَنَا عَبْدُ اللَّهِ بْنُ شَوْذَبٍ، حَدَّثَنَا عَنْ مَطَرٍ، قَالَ: سَأَلْتُ
الْحَسَنَ، وَعَطَاءً عَنْ الرَّجُلِ تَكُونُ مَعَهُ امْرَأَتُهُ فِي سَفَرٍ فَتَحِيضُ، ثُمَّ تَطْهُرُ، وَلَا تَجِدُ الْمَاءَ، قَالَا:
"تَتَيَمَّمُ وَتُصَلِّي"، قَالَ: قُلْتُ لَهُمَا: يَطَؤُهَا زَوْجُهَا ؟، قَالَا: "نَعَمْ، الصَّلَاةُ أَعْظَمُ مِنْ ذَلِكَ".
Matar (al-Warraq) narrated that I asked Hasan and Ata’ (may Allah have mercy on them) about a man who is traveling with his wife, and she gets her menses, then becomes pure but does not find water. Both of them said: She should perform tayammum and pray. Matar said: Can her husband have intercourse with her in this state? They replied: Prayer is greater than that. That is, if she can pray, then she can also be intimate with her husband.
Hadith 1210
حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ، عَنْ ابْنِ الْمُبَارَكِ، عَنْ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، فِي الْمَرْأَةِ تَطْهُرُ وَلَا تَجِدُ الْمَاء، قَالَ: "يُصِيبُهَا زَوْجُهَا إِذَا تَيَمَّمَتْ"، سُئِلَ عَبْد اللَّهِ: تَقُولُ بِهَذَا ؟، قَالَ: إِي وَاللَّهِ.
It is narrated from Ata (may Allah have mercy on him): If a woman becomes pure from menstruation but does not find water, he said: When she performs tayammum, her husband may have intercourse with her. Imam Darimi (may Allah have mercy on him) was asked: Is this your opinion as well? He replied: Yes, by Allah.
