Hadith 1140
أَخْبَرَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا يَزِيدُ بْنُ إِبْرَاهِيمَ، قَالَ: سَمِعْتُ الْحَسَنَ، يَقُولُ فِي الَّذِي يُفْطِرُ يَوْمًا مِنْ رَمَضَانَ، قَالَ: "عَلَيْهِ عِتْقُ رَقَبَةٍ، أَوْ بَدَنَةٌ، أَوْ عِشْرِينَ صَاعًا لِأَرْبَعِينَ مِسْكِينًا، وَفِي الَّذِي يَغْشَى امْرَأَتَهُ وَهِيَ حَائِضٌ، مِثْلُ ذَلِكَ".
Yazid bin Ibrahim narrated that I heard Imam Hasan al-Basri, may Allah have mercy on him, say about the person who does not fast during the days of Ramadan: He must offer expiation by freeing a slave, or slaughtering a camel, or giving twenty sa’ (approximately 45 kilograms) of grain to forty needy people. And the same expiation is obligatory upon the person who has intercourse with his wife while she is menstruating.
Hadith 1141
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) regarding a person who has intercourse with his wife during her menstruation, the Messenger of Allah (peace and blessings be upon him) said: "He should give half a dinar in charity."
Hadith 1142
It is narrated from Muqassim that Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: Whoever has intercourse with his wife during her menstruation should give a dinar or half a dinar in charity; there is doubt whether he said a dinar or half a dinar as a ruling.
Hadith 1143
أَخْبَرَنَا أَخْبَرَنَا
سَعِيدُ بْنُ عَامِرٍ، عَنْ
شُعْبَةَ، عَنْ
الْحَكَمِ، عَنْ
عَبْدِ الْحَمِيدِ، عَنْ
مِقْسَمٍ، عَنْ
ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا، فِي الَّذِي يَغْشَى امْرَأَتَهُ وَهِيَ حَائِضٌ
"يَتَصَدَّقُ بِدِينَارٍ، أَوْ نِصْفِ دِينَارٍ"، قَالَ شُعْبَةُ: أَمَّا حِفْظِي فَهُوَ مَرْفُوعٌ، وَأَمَّا فُلَانٌ وَفُلَانٌ، فَقَالَا: غَيْرُ مَرْفُوعٍ، فَقَالَ بَعْضُ الْقَوْمِ: حَدِّثْنَا بِحِفْظِكَ، وَدَعْ مَا قَالَ فُلَانٌ وَفُلَانٌ، فَقَالَ: "وَاللَّهِ مَا أُحِبُّ أَنِّي عُمِّرْتُ فِي الدُّنْيَا عُمُرَ نُوحٍ وَأَنِّي حَدَّثْتُ بِهَذَا، أَوْ سَكَتُّ عَنْ هَذَا"، قَالَ أَبُو مُحَمَّد: عَبْدُ الحَمِيدِ بْنُ زَيْدِ بْنِ عَبْدِ الرَّحمَنِ بْنِ زَيدِ بْنِ الخَطَّابِ وَكَانَ وَالِيَ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ عَلَى الْكُوفَةِ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: Whoever has intercourse with his wife during her menstruation should give a dinar or half a dinar in charity. Shu’bah said: In my memory, this ruling is marfu’ (attributed to the Prophet), and so-and-so mentioned it as the non-marfu’ statement of Sayyiduna Ibn Abbas (may Allah be pleased with them both). Someone said: Narrate to us from your memory and leave aside the statement of so-and-so. He replied: By Allah, even if I were to meet the lifespan of Nuh (peace be upon him), I would not like to narrate it or remain silent about it. Abu Muhammad Darimi (may Allah have mercy on him) said: Abdul Hamid is Ibn Zayd ibn Abdur Rahman ibn Zayd ibn al-Khattab, who was the governor of Kufa on behalf of Umar ibn Abdul Aziz (may Allah have mercy on him).
Hadith 1144
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: If intercourse is done during flowing blood, then one dinar; and if intercourse is done after the blood has stopped, then half a dinar.
Hadith 1145
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them) that the Noble Prophet (peace and blessings be upon him) said: "Whoever has intercourse with a menstruating woman should give half a dinar in charity."
Hadith 1146
Abdul Hameed bin Zaid bin Al-Khattab said: Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him) had a wife who disliked intercourse. Whenever he intended to approach her, she would make the excuse of menstruation. (On one occasion) he had intercourse with her, but then saw that she was telling the truth. So Sayyiduna Umar (may Allah be pleased with him) came to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) ordered him to give two-fifths of a dinar in charity.
Hadith 1147
It was asked from Sayyiduna Ibn Abbas (may Allah be pleased with them both) about a man who has intercourse with his wife during her menstrual period. He replied: He should give one dinar or half a dinar in charity. Imam Ibrahim Nakha’i (may Allah have mercy on him) said: And he should also seek forgiveness.
Hadith 1148
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: "When a man has intercourse with his wife during her menstruation, if the blood is fresh and red, he should give one dinar in charity (as expiation), and if the blood is yellowish, he should give half a dinar in charity." Imam Ibrahim (may Allah have mercy on him) said: And he should seek forgiveness.
Hadith 1149
أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ، عَنْ خَالِدِ بْنِ عَبْدِ اللَّهِ، عَنِ ابْنِ أَبِي لَيْلَى، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا، قَالَ: «إِذَا وَقَعَ عَلَى امْرَأَتِهِ وَهِيَ حَائِضٌ، فَعَلَيْهِ أَنْ يَتَصَدَّقَ بِدِينَارٍ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: When a man has intercourse with his wife while she is menstruating, he must give one dinar in charity. Imam Ibrahim (may Allah have mercy on him) said: And he must also seek forgiveness.
Hadith 1150
أَخْبَرَنَا يَعْلَى بْنُ عُبَيْدٍ، حَدَّثَنَا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، فِي رَجُلٍ جَامَعَ امْرَأَتَهُ وَهِيَ حَائِضٌ، قَالَ: «يَتَصَدَّقُ بِدِينَارٍ»
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) regarding a man who has intercourse with his wife during her menstruation, he said: It will be obligatory for him to give one dinar in charity.
Hadith 1151
It is narrated from Muqassim that Sayyiduna Ibn Abbas (may Allah be pleased with them) said: A person will give a dinar or half a dinar in charity.
Hadith 1152
أَخْبَرَنَا وَهْبُ بْنُ سَعِيدٍ، عَنْ شُعَيْبِ بْنِ إِسْحَاق، عَنْ الْأَوْزَاعِيِّ فِي رَجُلٍ يَغْشَى امْرَأَتَهُ وَهِيَ حَائِضٌ، أَوْ رَأَتْ الطُّهْرَ وَلَمْ تَغْتَسِلْ، قَالَ: "يَسْتَغْفِرُ اللَّهَ، وَيَتَصَدَّقُ بِخُمُسَيْ دِينَارٍ".
It is also narrated from Imam Awza'i, may Allah have mercy on him, regarding a man who has intercourse with his wife during her menstruation or after she becomes pure but before she performs ghusl (ritual bath), he said: That man should seek forgiveness from Allah and give one-fifth of a dinar in charity.
Hadith 1153
أَخْبَرَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ عَبْدِ الْمَلِكِ، عَنْ عَطَاءٍ، قَالَ: "إِذَا وَقَعَ الرَّجُلُ عَلَى امْرَأَتِهِ وَهِيَ حَائِضٌ يَتَصَدَّقُ بِنِصْفِ دِينَارٍ"، فَقَالَ لَهُ رَجُلٌ مِنْ الْقَوْمِ: فَإِنَّ الْحَسَنَ، يَقُولُ: يُعْتِقُ رَقَبَةً، فَقَالَ: "مَا أَنْهَاكُمْ أَنْ تَقَرَّبُوا إِلَى اللَّهِ مَا اسْتَطَعْتُمْ".
Ata (may Allah have mercy on him) said: When a man has intercourse with his wife during her menstruation, he should give half a dinar in charity. One of those present said: Hasan (al-Basri, may Allah have mercy on him) says to free a slave? He replied: I do not prevent you from that; seek nearness to Allah as much as you can. That is, along with repentance and seeking forgiveness, the more charity you give, the better.
Hadith 1154
It is narrated from Ata (may Allah have mercy on him) that Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: Whoever has intercourse with his wife during her menstruation will give one dinar in charity.
