باب إِذَا أَتَى امْرَأَتَهُ وَهِيَ حَائِضٌ:
Chapter: Having Intercourse with One's Wife While She is Menstruating
Hadith 1132
أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا هُشَيْمٌ، أَخْبَرَنَا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ . ح وأَخْبَرَنَا إِسْمَاعِيل بْنُ أَبِي خَالِدٍ، عَنْ عَامِرٍ فِيمَنْ أَتَى أَهْلَهُ وَهِيَ حَائِضٌ، قَالَا: "ذَنْبٌ أَتَاهُ، يَسْتَغْفِرُ اللَّهَ، وَيَتُوبُ إِلَيْهِ، وَلَا يَعُودُ".
Ismail bin Abi Khalid and Amir Sha'bi, may Allah have mercy on them both, said regarding the person who has intercourse with his wife during her menstruation: He has committed a sin, he should seek forgiveness from Allah, repent, and not do it again in the future.
Hadith 1133
أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا يَحْيَى بْنُ أَبِي زَائِدَةَ، عَنْ الْمُثَنَّى، عَنْ عَطَاءٍ، مِثْلَهُ.
This aforementioned statement is also narrated from Ata (may Allah have mercy on him).
Hadith 1134
حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، وَأَبُو النُّعْمَانِ، قَالَا: حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ يَعْقُوبَ بْنِ الْقَعْقَاعِ، عَنْ مُحَمَّدِ بْنِ زَيْدٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ: "ذَنْبٌ أَتَاهُ، وَلَيْسَ عَلَيْهِ كَفَّارَةٌ".
Saeed bin Jubair (may Allah have mercy on him) said: He has sinned, but there is no expiation upon him.
Hadith 1135
أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، أَنَّهُ سُئِلَ عَنْ الَّذِي يَأْتِي امْرَأَتَهُ وَهِيَ حَائِضٌ، قَالَ: "يَعْتَذِرُ إِلَى اللَّهِ، وَيَتُوبُ إِلَى اللَّهِ".
Abdur Rahman bin Qasim narrated from his father Qasim: He was asked about a man who has intercourse with his wife while she is menstruating? He said: He should seek forgiveness from Allah and repent.
Hadith 1136
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، قَالَ: "تَسْتَغْفِرُ اللَّهَ، وَلَيْسَ عَلَيْكَ شَيْءٌ"، يَعْنِي: إِذَا وَقَعَ عَلَى امْرَأَتِهِ وَهِيَ حَائِضٌ.
It is narrated from Ata (may Allah have mercy on him): He should seek forgiveness from Allah and there is no expiation upon him. That is, when a man has intercourse with his wife during her menstrual period (there is no expiation upon him, he should just repent and seek forgiveness).
Hadith 1137
أَخْبَرَنَا عُثْمَانُ بْنُ مُحَمَّدٍ، حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ، عَنْ مَالِكِ بْنِ الْخَطَّابِ الْعَنْبِرِيِّ، عَنْ ابْنِ أَبِي مُلَيْكَةَ، قَالَ: سُئِلَ وَأَنَا أَسْمَعُ عَنْ الرَّجُلِ يَأْتِي امْرَأَتَهُ وَهِيَ حَائِضٌ، قَالَ: "يَسْتَغْفِرُ اللَّهَ".
It is narrated from Malik bin Al-Khattab Al-Anbari: I was listening when Ibn Abi Mulaykah was asked, "What if a man has intercourse with his wife during her menstruation?" He replied: He should seek forgiveness from Allah.
Hadith 1138
حَدَّثَنَا حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلَابَةَ، أَنَّ رَجُلًا أَتَى أَبَا بَكْرٍ رَضِيَ اللهُ عَنْهُ، فَقَالَ: رَأَيْتُ فِي الْمَنَامِ كَأَنِّي أَبُولُ دَمًا، قَالَ: تَأْتِي امْرَأَتَكَ وَهِيَ حَائِضٌ ؟، قَالَ: نَعَمْ، قَالَ: "اتَّقِ اللَّهَ، وَلَا تَعُدْ".
It is narrated from Abu Qilabah (may Allah have mercy on him): A man came to Sayyiduna Abu Bakr (may Allah be pleased with him) and said, "I saw in a dream that I was urinating blood." He interpreted it: "You have intercourse with your wife during her menstrual period." The man said, "Yes, that is true." He said, "Fear Allah, and do not do this again."
Hadith 1139
أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ هِشَامٍ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، فِي الَّذِي يَقَعُ عَلَى امْرَأَتِهِ وَهِيَ حَائِضٌ، قَالَ: "يَسْتَغْفِرُ اللَّهَ".
It is narrated from Imam Muhammad bin Sirin, may Allah have mercy on him, regarding a man who has intercourse with his wife during her menstrual period, he said: He should seek forgiveness from Allah.
