Hadith 1113
حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا هُشَيْمٌ، حَدَّثَنَا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، وَيُونُسُ، عَنْ الْحَسَنِ، وَعَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، قَالَ مُحَمَّدٌ، وَحَدَّثَنِي يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ، عَنْ عُثْمَانَ بْنِ الْأَسْوَدِ، عَنْ مُجَاهِدٍ، فِي الْحَائِضِ "إِذَا طَهُرَتْ مِنْ الدَّمِ لَا يَقْرَبُهَا زَوْجُهَا حَتَّى تَغْتَسِلَ" .
It is narrated from Mujahid (may Allah have mercy on him): When a menstruating woman becomes pure (i.e., her menstrual blood stops), her husband should not approach her until she has performed ghusl (ritual bath).
Hadith 1114
حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ عُثْمَانَ بْنِ الْأَسْوَدِ، عَن مُجَاهِدٍ، مِثْلَهُ سَوَاءً.
It is also narrated in a similar way from Mujahid (may Allah have mercy on him) through another chain of transmission.
Hadith 1115
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، قَالَ: سُئِلَ سُفْيَانُ: "أَيُجَامِعُ الرَّجُلُ امْرَأَتَهُ إِذَا انْقَطَعَ عَنْهَا الدَّمُ قَبْلَ أَنْ تَغْتَسِلَ ؟، فَقَالَ: لَا، فَقِيلَ: أَرَأَيْتَ إِنْ تَرَكَتْ الْغُسْلَ يَوْمَيْنِ أَوْ أَيَّامًا ؟، قَالَ: تُسْتَتَابُ".
Sufyan, may Allah have mercy on him, was asked: If the menstrual blood of a woman stops, can her husband have intercourse with her before she performs ghusl? He replied: No. It was asked: If she does not perform ghusl for one or two days? He replied: She will be made to repent.
Hadith 1116
أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَمَّنْ حَدَّثَهُ، عَنْ مُجَاهِدٍ "وَلا تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ سورة البقرة آية 222، قَالَ: حَتَّى يَنْقَطِعَ الدَّمُ، فَإِذَا تَطَهَّرْنَ سورة البقرة آية 222، قَالَ: إِذَا اغْتَسَلْنَ".
Mujahid (may Allah have mercy on him) said about the verse «﴿وَلَا تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ فَإِذَا تَطَهَّرْنَ﴾» [بقرة: 222/2]: «يَطْهُرْنَ» means when the blood stops, and «فَإِذَا تَطَهَّرْنَ» means when they have performed ghusl (ritual bath).
Hadith 1117
حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ سُفْيَانَ، عَنْ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ "حَتَّى يَطْهُرْنَ سورة البقرة آية 222، قَالَ: إِذَا انْقَطَعَ الدَّمُ، فَإِذَا تَطَهَّرْنَ سورة البقرة آية 222، قَالَ: اغْتَسَلْنَ".
It is narrated from Mujahid, may Allah have mercy on him, that « ﴿حَتَّى يَطْهُرْنَ﴾ » means when the flow of blood stops, and «﴿فَإِذَا تَطَهَّرْنَ﴾» said: that is, when she performs ghusl (ritual bath).
Hadith 1118
أَخْبَرَنَا عُبَيْدُ اللَّهِ، حَدَّثَنَا عُثْمَانُ بْنُ الْأَسْوَدِ، قَالَ: سَأَلْتُ مُجَاهِدًا، عَنْ امْرَأَةٍ رَأَتْ الطُّهْرَ: أَيَحِلُّ لِزَوْجِهَا أَنْ يَأْتِيَهَا قَبْلَ أَنْ تَغْتَسِلَ ؟، قَالَ: "لَا حَتَّى تَحِلَّ لَهَا الصَّلَاةُ".
‘Uthman bin al-Aswad said: I asked Mujahid (may Allah have mercy on him) about a woman who gets her menses: Is it permissible for her husband to have intercourse with her before she performs ghusl (ritual bath)? He replied: No, as long as prayer is not permissible (intercourse is also not permissible).
Hadith 1119
أَخْبَرَنَا الْمُعَلَّى بْنُ أَسَدٍ، حَدَّثَنَا عَبْدُ الْوَاحِدِ هُوَ ابْنُ زِيَادٍ، حَدَّثَنَا الْحَجَّاجُ بْنُ أَرْطَاةَ، قَالَ: سَأَلْتُ عَطَاءً، وَمَيْمُونَ بْنَ مِهْرَانَ، وَحَدَّثَنِي حَمَّادٌ، عَنْ إِبْرَاهِيمَ، قَالُوا: "لَا يَغْشَاهَا حَتَّى تَغْتَسِلَ".
It is narrated from Hammad that Imam Ibrahim (may Allah have mercy on him) said: Do not have intercourse until you have performed ghusl (ritual bath).
Hadith 1120
أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، عَنْ هِشَامٍ، عَنْ الْحَسَنِ فِي الرَّجُلِ يَطَأُ امْرَأَتَهُ وَقَدْ رَأَتْ الطُّهْرَ قَبْلَ أَنْ تَغْتَسِلَ، قَالَ: "هِيَ حَائِضٌ مَا لَمْ تَغْتَسِلْ، وَعَلَيْهِ الْكَفَّارَةُ، وَلَهُ أَنْ يُرَاجِعَهَا مَا لَمْ تَغْتَسِلْ".
It is narrated from Imam Hasan, may Allah have mercy on him, about the man who has intercourse with his wife after her period but before she has performed ghusl (ritual bath), he said: Until she performs ghusl, she is under the same ruling as a menstruating woman, and expiation is due upon him. He should ask about the matter of ghusl.
Hadith 1121
أَخْبَرَنَا الْمُعَلَّى بْنُ أَسَدٍ، حَدَّثَنَا عَبْدُ الْوَاحِدِ، حَدَّثَنَا يُونُسُ، عَنْ الْحَسَنِ، قَالَ: "لَا يَغْشَاهَا زَوْجُهَا".
It is narrated from Imam Hasan, may Allah have mercy on him: A man will not have intercourse with such a woman.
Hadith 1122
Abu al-Khair Mirthad al-Yazani said: I heard Sayyiduna Uqbah bin Amir al-Juhani, may Allah be pleased with him, say: By Allah, I do not have intercourse with my wife on the day she becomes pure until another day has passed.
Hadith 1123
أَخْبَرَنَا يَعْلَى بْنُ عُبَيْدٍ حَدَّثَنَا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ فِي الْمَرْأَةِ تَرَى الطُّهْرَ: أَيَأْتِيهَا زَوْجُهَا قَبْلَ أَنْ تَغْتَسِلَ ؟، قَالَ: "لَا، حَتَّى تَغْتَسِلَ".
It is narrated from Ata (may Allah have mercy on him): When a woman sees purity, can her husband have intercourse with her or not? He replied: Intercourse is not permissible until she performs ghusl (ritual bath).
Hadith 1124
أَخْبَرَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ لَيْثِ بْنِ أَبِي سُلَيْمٍ، عَنْ عَطَاءٍ فِي الْمَرْأَةِ يَنْقَطِعُ عَنْهَا الدَّمُ، قَالَ: "إِنْ أَدْرَكَهُ الشَّبَقُ، غَسَلَتْ فَرْجَهَا ثُمَّ يَأْتِيَها".
It is narrated from Ata (may Allah have mercy on him) regarding a woman whose blood (menstruation) stops, he said: If the man's desire increases, then the woman should wash her private part, and then have intercourse.
Hadith 1125
أَخْبَرَنَا فَرْوَةُ بْنُ أَبِي الْمَغْرَاءِ، قَالَ: سَمِعْتُ شَرِيكًا وَسَأَلَهُ رَجُلٌ، فَقَالَ: الْمَرْأَةُ يَنْقَطِعُ عَنْهَا الدَّمُ: أَيَأْتِيهَا زَوْجُهَا قَبْلَ أَنْ تَغْتَسِلَ ؟، فَقَالَ: قَالَ عَبْدُ الْمَلِكِ: عَنْ عَطَاءٍ، أَنَّهُ "رَخَّصَ فِي ذَلِكَ لِلشَّبِقِ"، قَالَ أَبُو مُحَمَّد: أَخَافُ أَنْ يَكُونَ أَخَطَأً، وأَخَافُ أَنْ يَكُونَ مِنْ حَدِيثِ لَيْثٍ، لَا أَعْرِفُهُ مِنْ حَدِيثِ عَبْدِ الْمَلِكِ، قَالَ أَبُو مُحَمَّد: الشَّبِقُ الَّذِي يَشْتَهِي.
Furwah bin Abi Al-Mughra reported, I heard Shareek say, a man asked him: If a woman's blood stops, can her husband have intercourse with her before she performs ghusl (ritual bath)? Furwah gave the answer from Abdul Malik on the authority of Ata’ (may Allah have mercy on him) that he permitted intercourse before ghusl in the case of intense desire. Abu Muhammad Imam Darimi (may Allah have mercy on him) said: I fear that he made a mistake, and that this is narrated from Layth bin Abi Sulaim instead of Ata’ (may Allah have mercy on him), because I do not know of any such statement from Abdul Malik. Abu Muhammad (may Allah have mercy on him) said: «الشبق» refers to the man who has intense desire.
