Hadith 132
أَخْبَرَنَا أَخْبَرَنَا
سَلْمُ بْنُ جُنَادَةَ، حَدَّثَنَا
ابْنُ إِدْرِيسَ، عَنْ
عَمِّهِ، قَالَ:
"خَرَجْتُ مِنْ عِنْدِ إِبْرَاهِيمَ، فَاسْتَقْبَلَنِي حَمَّادٌ، فَحَمَّلَنِي ثَمَانِيَةَ أَبْوَابٍ، مَسَائِلَ، فَسَأَلْتُهُ، فَأَجَابَنِي عَنْ أَرْبَعٍ وَتَرَكَ أَرْبَعًا".
Abdullah bin Idris narrated from his uncle that when I left from Ibrahim al-Nakha'i, Hammad (may Allah have mercy on him) received me and asked me to inquire about eight types of issues. I asked Ibrahim about them, and he answered four of the issues and did not answer four types of questions.
Hadith 133
Zubayd al-Yami said: Whenever I asked Ibrahim about an issue, I noticed displeasure on his face.
Hadith 134
Umar bin Abi Zaidah said: I have not heard anyone say more than Imam Sha’bi (may Allah have mercy on him): «لا علم لي به» I do not know about it.
Hadith 135
أَخْبَرَنَا أَخْبَرَنَا
أَبُو عَاصِمٍ، عَنْ
ابْنِ عَوْنٍ، قَالَ: سَمِعْتُهُ يَذْكُرُ، قَالَ: كَانَ
الشَّعْبِيُّ إِذَا جَاءَهُ شَيْءٌ اتَّقَى، وَكَانَ
إِبْرَاهِيمُ يَقُولُ، وَيَقُولُ، وَيَقُولُ، قَالَ أَبُو عَاصِمٍ:
"كَانَ الشَّعْبِيُّ فِي هَذَا أَحْسَنَ حَالًا عِنْدَ ابْنِ عَوْنٍ مِنْ إِبْرَاهِيمَ".
Abu Asim heard Abdullah bin Aun say that when Sha’bi was asked about an issue, he would avoid answering, while Ibrahim (al-Nakha’i) would give a fatwa. Abu Asim said: In this regard, according to Ibn Aun, Sha’bi was better than Ibrahim (because of his caution).
Hadith 136
Ja'far bin Iyas said: I said to Sa'id bin Jubayr, may Allah have mercy on him: What is the matter that you do not speak about the issue of divorce? He said: There is nothing related to divorce about which I have not asked (i.e., have not acquired knowledge), but I do not like to declare the unlawful as lawful and the lawful as unlawful.
Hadith 137
Ata bin As-Sa'ib said: I heard Abdullah bin Abi Ya'la say, he said: I found one hundred and twenty Ansari Companions in this (Prophet's) mosque; whenever any of them narrated a hadith, he wished that his companion would narrate it instead, and if any of them was asked for a fatwa, he preferred that one of his companions would undertake that task.
Hadith 138
Dawud bin Abi Hind said: I asked Sha'bi: What would you do when you were asked about an issue? He replied: You have asked someone experienced in this matter. When someone was asked about an issue, he would say to his companion, "You answer," and the companion would say, "You answer," until after repetition, the question would return to the first person.
Hadith 139
Ibn al-Munkadir said: The scholar intervenes between Allah Almighty and His servants (through issuing fatwas), so he should seek a way out for himself (i.e., he should avoid issuing fatwas).
Hadith 140
أَخْبَرَنَا أَخْبَرَنَا
مُحَمَّدُ بْنُ قُدَامَةَ، حَدَّثَنَا
أَبُو أُسَامَةَ، عَنْ
مِسْعَرٍ، قَالَ: أَخْرَجَ إِلَيَّ
مَعْنُ بْنُ عَبْدِ الرَّحْمَنِ كِتَابًا، فَحَلَفَ لِي بِاللَّهِ أَنَّهُ خَطُّ
أَبِيه، فَإِذَا فِيهِ: قَال
عَبْدُ اللَّهِ:
"وَالَّذِي لَا إِلَهَ إِلَّا هُوَ مَا رَأَيْتُ أَحَدًا كَانَ أَشَدَّ عَلَى الْمُتَنَطِّعِينَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَمَا رَأَيْتُ أَحَدًا كَانَ أَشَدَّ عَلَيْهِمْ مِنْ أَبِي بَكْرٍ رَضِيَ اللهُ عَنْهُ، وَإِنِّي لَأَرَى عُمَرَ رَضِيَ اللهُ عَنْهُ كَانَ أَشَدَّ خَوْفًا عَلَيْهِمْ أَوْ لَهُمْ".
Mus‘ar said: Ma‘n bin ‘Abdur Rahman brought out a book for me and swore that it was written in the handwriting of his father. I saw that it was written in it: It is narrated from ‘Abdullah, he said: By Him besides whom there is no deity, I have not seen anyone more severe and harsh upon those who go to extremes than the Messenger of Allah (peace be upon him), then I have not seen anyone more severe upon them than Sayyiduna Abu Bakr (may Allah be pleased with him), and now I am seeing Sayyiduna ‘Umar (may Allah be pleased with him) that there is no one who fears them or makes others fear them more than him.
Hadith 141
‘Uthman bin Hadhir Azdi said: I went to Sayyiduna ‘Abdullah bin ‘Abbas (may Allah be pleased with them) and said: Advise me. He said: Listen! Adopt the fear of Allah and remain steadfast upon it. Follow (the Sunnah) and avoid innovations.
Hadith 142
أَخْبَرَنَا مَخْلَدُ بْنُ مَالِكٍ بن جابر، أَخْبَرَنَا النَّضْرُ بْنُ شُمَيْلٍ، عَنْ ابْنِ عَوْنٍ، عَنْ ابْنِ سِيرِينَ، قَالَ: "كَانُوا يَرَوْنَ أَنَّهُ عَلَى الطَّرِيقِ مَا كَانَ عَلَى الْأَثَرِ".
Imam Ibn Sirin, may Allah have mercy on him, said: People used to think that as long as a man acts upon the hadith, he is upon the straight path.
Hadith 143
أَخْبَرَنَا يُوسُفُ بْنُ مُوسَى، حَدَّثَنَا أَزْهَرُ، عَنْ ابْنِ عَوْنٍ، عَنْ ابْنِ سِيرِينَ، قَالَ: "مَا دَامَ عَلَى الْأَثَرِ، فَهُوَ عَلَى الطَّرِيقِ".
Imam Muhammad bin Sirin, may Allah have mercy on him, said: As long as a person acts upon the hadith, he is on the right path.
Hadith 144
It is narrated from Abu Qilabah that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Acquire knowledge before it is taken away, and the taking away of knowledge is that the people of knowledge come to an end. Beware! Protect yourselves from extremism, excessive scrutiny (over-analysis), and inventing new acts of worship, and hold firmly to the ancient way. (That is, adhere to the way of the Messenger of Allah, peace and blessings be upon him, and his companions, may Allah be pleased with them all.)
Hadith 145
حَدَّثَنَا
سُلَيْمَانُ بْنُ حَرْبٍ،
وَأَبُو النُّعْمَانِ، عَنْ
حَمَّادِ بْنِ زَيْدٍ، عَنْ
أَيُّوبَ، عَنْ
أَبِي قِلَابَةَ، قَالَ: قَالَ
ابْنُ مَسْعُودٍ رَضِيَ اللهُ عَنْهُ:
"عَلَيْكُمْ بِالْعِلْمِ قَبْلَ أَنْ يُقْبَضَ، وَقَبْضُهُ أَنْ يُذْهَبَ بِأَصْحَابِهِ، عَلَيْكُمْ بِالْعِلْمِ، فَإِنَّ أَحَدَكُمْ لَا يَدْرِي مَتَى يُفْتَقَرُ إِلَيْهِ أَوْ يُفْتَقَرُ إِلَى مَا عِنْدَهُ، إِنَّكُمْ سَتَجِدُونَ أَقْوَامًا يَزْعُمُونَ أَنَّهُمْ يَدْعُونَكُمْ إِلَى كِتَابِ اللَّهِ وَقَدْ نَبَذُوهُ وَرَاءَ ظُهُورِهِمْ، فَعَلَيْكُمْ بِالْعِلْمِ، وَإِيَّاكُمْ وَالتَّبَدُّعَ، وَإِيَّاكُمْ وَالتَّنَطُّعَ، وَإِيَّاكُمْ وَالتَّعَمُّقَ، وَعَلَيْكُمْ بِالْعَتِيقِ".
It is narrated from Abu Qilabah that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Acquire knowledge before it is taken away, and its being taken away means that the people of knowledge will be taken away. Hold fast to knowledge (because) none of you knows when he will be in need of it, or when someone who possesses knowledge will be needed. You will find many people who will think that they are calling towards the Book of Allah, while in fact they will have cast it behind their backs. Hold firmly to knowledge and beware of inventing new acts of worship (bid'ah), avoid exaggeration, refrain from unnecessary depth and intricacy, and follow the footsteps of the predecessors.
Hadith 146
أَخْبَرَنَا أَخْبَرَنَا
أَبُو النُّعْمَانِ، حَدَّثَنَا
حَمَّادُ بْنُ زَيْدٍ، حَدَّثَنَا
يَزِيدُ بْنُ حَازِمٍ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ رَجُلًا يُقَالُ لَهُ: صَبِيغٌ قَدِمَ الْمَدِينَةَ فَجَعَلَ يَسْأَلُ عَنْ مُتَشَابِهِ الْقُرْآنِ، فَأَرْسَلَ إِلَيْهِ
عُمَرُ رَضِيَ اللهُ عَنْهُ وَقَدْ أَعَدَّ لَهُ عَرَاجِينَ النَّخْلِ، فَقَالَ:
"مَنْ أَنْتَ ؟، قَالَ: أَنَا عَبْدُ اللَّهِ صَبِيغٌ، فَأَخَذَ عُمَرُ عُرْجُونًا مِنْ تِلْكَ الْعَرَاجِينِ، فَضَرَبَهُ وَقَالَ: أَنَا عَبْدُ اللَّهِ عُمَرُ فَجَعَلَ لَهُ ضَرْبًا حَتَّى دَمِيَ رَأْسُهُ، فَقَالَ: يَا أَمِيرَ الْمُؤْمِنِينَ، حَسْبُكَ، قَدْ ذَهَبَ الَّذِي كُنْتُ أَجِدُ فِي رَأْسِي".
Sulayman bin Yasar said: A man whose name was Sabigh came to Madinah and began asking about the mutashabihat (ambiguous) verses of the Qur'an. Sayyiduna Umar (may Allah be pleased with him) called for palm branches and summoned him. He asked, "Who are you?" He replied, "I am Allah's servant, Sabigh." Sayyiduna Umar (may Allah be pleased with him) picked up one of those branches and said, "I am Allah's servant, Umar," and began to beat him, until his head was covered in blood. Then he said, "Enough, O Commander of the Faithful, the doubts that had entered my mind have now gone."
Hadith 147
Lady Aisha (may Allah be pleased with her) said: The Messenger of Allah (peace and blessings be upon him) recited this verse: «﴿هُوَ الَّذِيْ أَنْزَلَ ...﴾» (Aal-e-Imran: 7/3) and said: "When you see people who seek out the ambiguous verses, then beware of them."
Hadith 148
Shaqiq said that Abdullah bin Mas'ud (may Allah be pleased with him) was asked about something, so he said: I dislike making something lawful for you which Allah Almighty has made unlawful for you, or declaring unlawful what Allah Almighty has made lawful.
Hadith 149
أَخْبَرَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ أَبِي إِسْحَاق الْفَزَارِيِّ، عَنْ ابْنِ عَوْنٍ، عَنْ ابْنِ سِيرِينَ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ، قَالَ: "لَأَنْ أَرُدَّهُ بِعِيِّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ أَتَكَلَّفَ لَهُ مَا لَا أَعْلَمُ".
Humaid bin Abdur Rahman said that, to refrain from answering due to lack of knowledge about something is more preferable and beloved to me than to make an effort regarding something about which I have no knowledge. (That is, expressing one’s lack of knowledge is better than unnecessary affectation.)
Hadith 150
أَخْبَرَنَا أَخْبَرَنَا
عَبْدُ اللَّهِ بْنُ صَالِحٍ، حَدَّثَنِي
اللَّيْثُ، أَخْبَرَنِي
ابْنُ عَجْلَانَ، عَنْ
نَافِعٍ مَوْلَى عَبْدِ اللَّهِ، أَنَّ صَبِيغًا الْعِرَاقِيَّ، جَعَلَ يَسْأَلُ عَنْ أَشْيَاءَ مِنْ الْقُرْآنِ فِي أَجْنَادِ الْمُسْلِمِينَ حَتَّى قَدِمَ مِصْرَ، فَبَعَثَ بِهِ عَمْرُو بْنُ الْعَاصِ رَضِيَ اللهُ عَنْهُ إِلَى
عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ، فَلَمَّا أَتَاهُ الرَّسُولُ بِالْكِتَابِ فَقَرَأَهُ، فَقَالَ: أَيْنَ الرَّجُلُ ؟، قَالَ: فِي الرَّحْلِ، قَالَ عُمَرُ:
"أَبْصِرْ أَنْ يَكُونُ ذَهَبَ فَتُصِيبَكَ مِنِّي بِهِ الْعُقُوبَةُ الْمُوجِعَةُ، فَأَتَاهُ بِهِ، فَقَالَ عُمَرُ: تَسْأَلُ مُحْدَثَةً، فَأَرْسَلَ عُمَرُ إِلَى رَطَائِبَ مِنْ جَرِيدٍ، فَضَرَبَهُ بِهَا حَتَّى تَرَكَ ظَهْرَهُ دَبِرَةً، ثُمَّ تَرَكَهُ حَتَّى بَرَأَ، ثُمَّ عَادَ لَهُ، ثُمَّ تَرَكَهُ حَتَّى بَرَأَ، فَدَعَا بِهِ لِيَعُودَ لَهُ، قَالَ: فَقَالَ صَبِيغٌ: إِنْ كُنْتَ تُرِيدُ قَتْلِي، فَاقْتُلْنِي قَتْلًا جَمِيلًا، وَإِنْ كُنْتَ تُرِيدُ أَنْ تُدَاوِيَنِي، فَقَدْ وَاللَّهِ بَرِئْتُ، فَأَذِنَ لَهُ إِلَى أَرْضِهِ، وَكَتَبَ إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ رَضِيَ اللهُ عَنْهُ، أَنْ لَا يُجَالِسَهُ أَحَدٌ مِنْ الْمُسْلِمِينَ، فَاشْتَدَّ ذَلِكَ عَلَى الرَّجُلِ، فَكَتَبَ أَبُو مُوسَى إِلَى عُمَرَ: أَنْ قَدْ حَسُنَتْ تَوْبَتُهُ، فَكَتَبَ عُمَرُ: أَنْ ائْذَنْ لِلنَّاسِ بِمُجَالَسَتِهِ".
Nafi’, the freed slave of Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), said: When Sabigh (ibn Ghusl) arrived in Egypt with the army of the Iraqi Muslims, asking questions about certain verses, Sayyiduna Amr bin al-As (may Allah be pleased with him) sent him to Sayyiduna Umar (may Allah be pleased with him). When the messenger brought the message to him, he asked: Where is that man? He replied: He is in the tent. Sayyiduna Umar (may Allah be pleased with him) said: Go and see, if he has run away, I will give you a painful punishment. So the messenger brought him (Sabigh) before him. Sayyiduna Umar (may Allah be pleased with him) said: Are you inventing new things? Then Sayyiduna Umar (may Allah be pleased with him) called for fresh branches and beat him so much that he was covered in blood, then let him go. When he and his wounds healed, he beat him again, then gave him respite, then called him again to make him taste (the punishment). Sabigh said: If you want to kill me, then kill me at once, and if you want to cure me, then by Allah, I am now cured. Then Sayyiduna Umar (may Allah be pleased with him) allowed him to return to his homeland, and wrote to Sayyiduna Abu Musa Ash’ari (may Allah be pleased with him) that no Muslim should sit with him. This was very hard on Sabigh. So Sayyiduna Abu Musa (may Allah be pleased with him) wrote to Sayyiduna Umar (may Allah be pleased with him) that he has sincerely repented. Sayyiduna Umar (may Allah be pleased with him) replied, permitting people to meet and sit with him.
Hadith 151
Ismail bin Abi Khalid said: I heard Amir (al-Sha'bi) saying that a man asked Sayyiduna Ubayy bin Ka'b (may Allah be pleased with him) for a fatwa, saying: O Abu al-Mundhir! What do you say about this matter? He replied: Son! The matter about which you are asking for a fatwa, has it actually occurred? He said: No. He replied: Then give me respite until it happens, then we will consider it and give you a fatwa.
Hadith 152
Masruq said: I was walking with Sayyiduna Ubayy bin Ka'b (may Allah be pleased with him) when a young man said: Uncle! What do you say about this matter? He said: Nephew! Has such (a matter) occurred? He replied: No. So he answered: If it has not happened, then spare us, until such a matter actually takes place.
Hadith 153
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ الْأَعْمَشِ، قَالَ: "كَانَ إِبْرَاهِيمُ إِذَا سُئِلَ عَنْ شَيْءٍ لَمْ يُجِبْ فِيهِ إِلَّا جَوَابَ الَّذِي سُئِلَ عَنْهُ".
A’mash (Sulaiman bin Mehran) said: When Imam Ibrahim al-Nakha’i (may Allah have mercy on him) was asked about issues, he would only answer those issues which had previously been asked of him.
Hadith 154
أَخْبَرَنَا الْحُسَيْنُ بْنُ مَنْصُورٍ، حَدَّثَنَا الْحُسَيْنُ بْنُ الْوَلِيدِ، عَنْ وُهَيْبٍ، عَنْ هِشَامٍ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ"أَنَّهُ كَانَ لَا يُفْتِي فِي الْفَرْجِ بِشَيْءٍ فِيهِ اخْتِلَافٌ".
Hisham bin Hassan said: Imam Muhammad bin Sirin, may Allah have mercy on him, would not give fatwas regarding disputed matters related to the private parts. (That is, in disputed matters of marriage and divorce. And Allah knows best.)
Hadith 155
أَخْبَرَنَا
مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا
حَمَّادُ بْنُ زَيْدٍ، حَدَّثَنَا
الصَّلْتُ بْنُ رَاشِدٍ، قَالَ: سَأَلْتُ
طَاوُسًا عَنْ مَسْأَلَةٍ، فَقَالَ لِي: كَانَ هَذَا ؟، قُلْتُ: نَعَمْ، قَالَ: آللَّهِ، قُلْتُ: آللَّهِ، ثُمّ قَالَ: إِنَّ
أَصْحَابَنَا أَخْبَرُونَا عَنْ
مُعَاذِ بْنِ جَبَلٍ رَضِيَ اللهُ عَنْهُ، أَنَّهُ قَالَ: "يَا أَيُّهَا النَّاسُ،
لَا تَعْجَلُوا بِالْبَلَاءِ قَبْلَ نُزُولِهِ , فَيُذْهَبُ بِكُمْ هَهُنَا وَهَهُنَا، فَإِنَّكُمْ إِنْ لَمْ تَعْجَلُوا بِالْبَلَاءِ قَبْلَ نُزُولِهِ، لَمْ يَنْفَكَّ الْمُسْلِمُونَ أَنْ يَكُونَ فِيهِمْ مَنْ إِذَا سُئِلَ، سُدَّدَ، وَإِذَا قَالَ , وُفِّقَ".
Salat bin Rashid said: I asked Imam Tawus, may Allah have mercy on him, about a certain issue, so he inquired: Has this issue actually occurred? I said: Yes. He said: Swear that it has happened. I said: By Allah, it has happened. Then he said: Our companions have informed us from our master Mu'adh bin Jabal, may Allah be pleased with him, that he said: Do not be hasty regarding calamity and affliction before it descends, for it may mislead you here and there. If you are not hasty before the calamity descends, you will not be able to avoid it when it comes. As long as there are people who, when asked, give correct answers, and when they speak, they speak correctly.
Hadith 156
حَدَّثَنَا حَدَّثَنَا
بِشْرُ بْنُ الْحَكَمِ، حَدَّثَنَا
عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ
عَمْرِو بْنِ مَيْمُونٍ، عَنْ
أَبِيهِ، عَنْ
ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا، قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ أَدْرَكَهُ رَمَضَانَانِ، فَقَالَ: أَكَانَ أَوْ لَمْ يَكُنْ ؟، قَالَ: لَمْ يَكُنْ بَعْدُ، فَقَالَ: اتْرُكْ بَلِيَّتَهُ حَتَّى تَنْزِلَ، قَالَ: فَدَلَسْنَا لَهُ رَجُلًا، فَقَالَ: قَدْ كَانَ، فَقَالَ
"يُطْعِمُ عَنْ الْأَوَّلِ مِنْهُمَا ثَلَاثِينَ مِسْكِينًا، لِكُلِّ يَوْمٍ مِسْكِينٌ".
Amr bin Maymun narrated from his father, who narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them), that he said: I asked Sayyiduna Ibn Abbas (may Allah be pleased with them) about a person who witnessed two months of Ramadan and (did not fast), he said: Has this happened or not? Maymun said: No, so Sayyiduna Ibn Abbas (may Allah be pleased with them) said: Leave the calamity that has not yet occurred (i.e., do not ask about something that has not happened), so we made up a story about a person that he is facing this issue, then he replied that for the thirty fasts of the first Ramadan, he should feed the poor, one poor person for each day.
Hadith 157
Ubaid bin Jurayj said that one day in Makkah I was sitting with Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), and another day I was sitting with Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both). I observed that Sayyiduna Ibn Umar (may Allah be pleased with them both), in most matters, instead of giving a fatwa, would often say: «لاعلم لي» that I do not have knowledge about this.
Hadith 158
It is narrated from Abu Wa'il that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Acquire knowledge, for none of you knows when people will come to him for questions and fatwas.
