Hadith 762

أَخْبَرَنَا الْمُعَلَّى بْنُ أَسَدٍ، حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، حَدَّثَنَا الْأَعْمَشُ، عَنْ مُجَاهِدٍ، عَنْ طَاوُسٍ، عَنْ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُ، قَالَ: مَرَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِقَبْرَيْنِ، فَقَالَ: "إِنَّهُمَا لَيُعَذَّبَانِ فِي قُبُورِهِمَا، وَمَا يُعَذَّبَانِ فِي كَبِيرٍ: كَانَ أَحَدُهُمَا يَمْشِي بِالنَّمِيمَةِ، وَكَانَ الْآخَرُ لَا يَسْتَنْزِهُ عَنْ الْبَوْلِ، أَوْ مِنْ الْبَوْلِ"، قَالَ: "ثُمَّ أَخَذَ جَرِيدَةً رَطْبَةً فَكَسَرَهَا، فَغَرَزَ عِنْدَ رَأْسِ كُلِّ قَبْرٍ مِنْهُمَا قِطْعَةً"، ثُمَّ قَالَ: "عَسَى أَنْ يُخَفَّفَ عَنْهُمَا حَتَّى تَيْبَسَا".
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them) that the Messenger of Allah (peace and blessings be upon him) passed by two graves and said: "They are being punished in their graves, and not for a major sin. One of them used to go about spreading slander, and the other did not protect himself from urine splashes." The narrator said: Then the Prophet (peace and blessings be upon him) took a fresh twig, split it, and placed a piece at the head of each grave, then said: "Perhaps their punishment will be lightened as long as these twigs do not dry."

Brief Explanation
(Commentary on Hadith 761)

From this hadith, it is understood that tale-bearing (chughal khori) and not protecting oneself from urine splashes are major sins (kabirah) due to which a person is punished in the grave. Placing a fresh twig was something specific to the Messenger of Allah (sallallahu alayhi wa sallam), and he (sallallahu alayhi wa sallam) supplicated to Allah Ta'ala that their punishment be lightened, which Allah Ta'ala accepted. It is not permissible for anyone else to do this, because this is a matter of the unseen (amr ghaybi); who can know what is happening inside the grave? Furthermore, to do so based on conjecture is to think ill of the occupant of the grave, assuming that he is being punished.
