Hadith 748

أَخْبَرَنَا أَحْمَدُ بْنُ خَالِدٍ الْوَهْبِيُّ، عَنْ مُحَمَّدِ بْنِ إِسْحَاق، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، عَنْ عُرْوَةَ، عَنْ مَرْوَانَ بْنِ الْحَكَمِ، عَنْ بُسْرَةَ بِنْتِ صَفْوَانَ رَضِيَ اللهُ عَنْهُمَا، أَنَّهَا سَمِعَتْ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: "مَنْ مَسَّ فَرْجَهُ، فَلْيَتَوَضَّأْ"، قَالَ أَبُو مُحَمَّد: هَذَا أَوْثَقُ فِي مَسِّ الْفَرْجِ، وَقَالَ: الْوُضُوءُ أَثْبَتُ.
It is narrated from Sayyida Busrah bint Safwan (may Allah be pleased with her) that she heard the Messenger of Allah (peace and blessings be upon him) say: "Whoever touches his private part should perform ablution." Imam Darimi (may Allah have mercy on him) said: This is the most reliable narration regarding the private part.

Brief Explanation
(Commentary on Ahadith 746 to 748)

There is a difference of opinion among the Companions, the Followers (Tabi‘in), scholars, and jurists regarding the nullification of ablution (wudu) by touching the private parts (dhikr and farj).

The correct and summarized view is that touching the private part without any barrier nullifies ablution (wudu), as is established from the aforementioned ahadith and the hadith of Sayyiduna Abu Hurairah radi Allahu anhu. As for those who have deduced from the narration of Taliq bin Ali that it is merely a part of the body, that hadith does not reach the level of the aforementioned hadith of Busrah. Therefore, the preferred opinion is that ablution (wudu) is nullified by touching the private part.
