Abu Ishaq said: A seven-year-old boy from the tribe, whose name was Abbas bin Mirthad, made a will to give forty dirhams to a Jewish wet nurse from among his people of Hira. So Qadi Shurayh said: When the boy is rightful in his will, then the will is valid; he has made the will for the one who has the right. Imam Abu Muhammad Darimi, may Allah have mercy on him, said: I also say the same.

Ahl al-Dhimmah are those non-Muslims who are under the protection of the Islamic government. If any of their relatives is a Muslim, then he can make a bequest (wasiyyah) in their favor, and this bequest will remain valid and effective, as is evident from Umm al-Mu’minin Sayyidah Safiyyah radi Allahu anha and ‘Abbas ibn Mirthad making a bequest to a Jew.
