حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو بَكْرٍ، عَنْ مُطَرِّفٍ، عَنْ الشَّعْبِيِّ: "فِي رَجُلٍ قَالَ: أَحَدُ غُلَامَيَّ حُرٌّ ثُمَّ مَاتَ، وَلَمْ يُبَيِّنْ، قَالَ: الْوَرَثَةُ بِمَنْزِلَتِهِ يُعْتِقُونَ أَيَّهُمَا أَحَبُّوا".
Shu’bi, may Allah have mercy on him, said: If a man says: One of my two slaves is free, and he dies before specifying which one, then Shu’bi, may Allah have mercy on him, said: The heirs of the one who made the bequest will take his place, and whichever of the two they consider better, they will set free.
