حَدَّثَنَا الْحَسَنُ بْنُ بِشْرٍ، حَدَّثَنَا الْمُعَافَى، عَنْ عُثْمَانَ بْنِ الْأَسْوَدِ، عَنْ عَطَاءٍ، قَالَ: "مَنْ أَوْصَى أَوْ أَعْتَقَ، فَكَانَ فِي وَصِيَّتِهِ عَوْلٌ، دَخَلَ الْعَوْلُ عَلَى أَهْلِ الْعَتَاقَةِ، وَأَهْلِ الْوَصِيَّةِ" . قَالَ عَطَاءٌ: إِنَّ أَهْلَ الْمَدِينَةِ غَلَبُونَا، يَبْدَءُونَ بِالْعَتَاقَةِ قَبْلُ.
It is narrated from Ata that if a person makes a will and frees (a slave), and there is 'awl' (i.e., the shares are more than the estate) in his will, then this 'awl' will apply to all those involved in the freedom and the will. Ata said: The people of Madinah have prevailed over us in this matter; they begin with freedom (of the slave).
