حَدَّثَنَا حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، عَنْ عَمْرٍو، عَنْ الْحَسَنِ: "فِي رَجُلٍ قَالَ لِغُلَامِهِ: إِنْ دَخَلْتُ دَارَ فُلَانٍ، فَغُلَامِي حُرٌّ، ثُمَّ دَخَلَهَا وَهُوَ مَرِيضٌ، قَالَ: يُعْتَقُ مِنْ الثُّلُثِ، وَإِنْ دَخَلَ فِي صِحَّتِهِ، عُتِقَ مِنْ جَمِيعِ الْمَالِ".
Hasan (may Allah have mercy on him) was asked about a person who said to his slave: "If I enter so-and-so's house, then my slave is free." Then he entered that house while he was ill. Hasan (may Allah have mercy on him) said: He will be freed from one third of the wealth, and if he entered that house while he was healthy, then he will be freed from the entire wealth.
Brief Explanation

The will (wasiyyah) of a sick person shall be executed from up to one third of his wealth during the state of illness, as has been written above.
