Hadith 3231

حَدَّثَنَا يَعْلَى، حَدَّثَنَا إِسْمَاعِيل، عَنْ عَامِرٍ، قَالَ: "إِنَّمَا كَانُوا يُوصُونَ بِالْخُمُسِ وَالرُّبُعِ، وَكَانَ الثُّلُثُ مُنْتَهَى الْجَامِحِ . قَالَ أَبُو مُحَمَّد: يَعْنِي بِالْجَامِحِ: الْفَرَسَ الْجَمُوحَ.
‘Amir (Sha‘bi), may Allah have mercy on him, said: People used to make bequests of one-fifth and one-fourth, and one-third was the limit of abstention. Imam Darimi, may Allah have mercy on him, said: “Jamih” means a disobedient, unruly horse.

Brief Explanation
(Commentary on Ahadith 3229 to 3231)

Khums means one-fifth, and rub‘ means one-fourth; that is, they used to make a bequest (wasiyyah) of less than one-third. And in their view, one-third was the limit of disobedience, meaning that making a bequest of more than this was considered prohibited.
