Hadith 3208

حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ، أَخْبَرَنَا عُبَيْدُ اللَّهِ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ: أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: "مَاحَقُّ امْرِئٍ مُسْلِمٍ يَبِيتُ لَيْلَتَيْنِ وَلَهُ شَيْءٌ يُوصِي فِيهِ، إِلَّا وَوَصِيَّتُهُ مَكْتُوبَةٌ عِنْدَهُ".
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "It is not permissible for any Muslim who has something to bequeath to spend two nights without having his will written with him."

Brief Explanation
(Commentary on Hadiths 3206 to 3208)

That is, it is not appropriate to spend even two nights without a will (wasiyyah).

It is narrated from Sayyiduna Ibn Umar radi Allahu anhuma that ever since I heard this from the Messenger of Allah sallallahu alayhi wa sallam, I have always kept my will written.

When a person near death makes a decision regarding the care of something after his death, or to spend his wealth in a good deed, and instructs someone regarding it, this is called a will (wasiyyah). And there are two types of wills: one is that the dying person owes a debt or holds someone’s trust (amanah); the second is that he makes a will for a relative, or for a mosque, school, or orphans, that a portion of his wealth or property be spent in this good deed. Doing so is recommended (mustahabb), but this will should be in one third or less of the wealth. Furthermore, there are rulings and issues regarding the will, which will be mentioned ahead.

In the Noble Qur’an it is stated: “O you who believe! Let there be two witnesses among you when death approaches any of you, at the time of making a will—two just men from among you.” [المائده : 106]
