باب جَرِّ الْوَلاَءِ:Chapter on transferring wala'
Hadith 3205
حَدَّثَنَا حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: قَالَ عُمَرُ: "إِذَا كَانَتْ الْحُرَّةُ تَحْتَ الْمَمْلُوكِ، فَوَلَدَتْ لَهُ غُلَامًا، فَإِنَّهُ يُعْتَقُ بِعِتْقِ أُمِّهِ، وَوَلَاؤُهُ لِمَوَالِي أُمِّهِ، فَإِذَا أُعْتِقَ الْأَبُ، جَرَّ الْوَلَاءَ إِلَى مَوَالِي أَبِيهِ".
It is narrated from Ibrahim, may Allah have mercy on him, that Sayyiduna Umar, may Allah be pleased with him, said: If a free woman is married to a slave and a boy is born from this slave, then with the freedom of his mother, the boy will also be set free, and his wala’ (right of allegiance) will be for the owners of his mother. Then, when the slave is freed, his wala’ will transfer to the mawali (clients) of his father.
