Hadith 3194

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، قَالَ: قَالَ ابْنُ عَبَّاسٍ: "لَا يُبَاعُ الْوَلَاءُ، أَيُؤْكَلُ بِرَقَبَةِ رَجُلٍ مَرَّتَيْنِ ؟".
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: Wala’ cannot be sold. Can a man’s neck be consumed twice?

Brief Explanation
(Commentary on Ahadith 3189 to 3194)

From all these ahadith and athar, it is established that selling or gifting (hibah) of wala’ is not permissible. Therefore, this relationship cannot be transferred to anyone else through sale or gift. In wala’, the man or woman who emancipates (the slave) will be the heir of the freed slave or bondwoman, and if the emancipator is not present, then his agnatic (nasabi) male relatives will be the heirs—these too must be men; women will not inherit.
