Hadith 3189

حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا سُفْيَانُ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنْ ابْنِ عُمَرَ، قَالَ: "نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعِ الْوَلَاءِ، وَعَنْ هِبَتِهِ".
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them) that the Messenger of Allah (peace and blessings be upon him) forbade the selling and gifting of wala (the right of inheritance due to manumission).

Brief Explanation
(Explanation of Hadith 3188)
The details of walā’ have already been discussed previously in «كتاب البيوع ، باب النهي عن بيع الولاء». Walā’ is that relationship which remains between the master and the slave after the slave has been set free, and the one who frees the slave becomes his ‘aṣabah (agnatic relative). The master becomes entitled to inherit from him. Whether the slave’s emancipation is through tadbīr (conditional manumission), mukātabah (contractual manumission), or any other form, the walā’ belongs to the master. It cannot be sold nor gifted, because it is a relationship, and a relationship is not something that can be sold, nor can it be gifted under any circumstance.
