Hadith 3150

أَخْبَرَنَا أَبُو نُعَيْمٍ، وَعَبْدُ اللَّهِ بْنُ يَزِيدَ، قَالَا: حَدَّثَنَا شُعْبَةُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ أَبِي عَمْرٍو الشَّيْبَانِيِّ، قَالَ: َقَالَ عَبْدُ اللَّهِ: "السَّائِبَةُ يَضَعُ مَالَهُ حَيْثُ شَاءَ" . قَالَ عَبْدُ اللَّهِ بْنُ يَزِيدَ: قَالَ شُعْبَةُ: لَمْ يَسْمَعْ هَذَا مِنْ سَلَمَةَ أَحَدٌ غَيْرِي.
Abu Amr al-Shaibani said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: A freed slave may dispose of his wealth wherever he wishes. Abdullah bin Zaid said: Shu'bah (may Allah have mercy on him) said: No one heard this from Salamah bin Kuhail except me.

Brief Explanation
(Explanation of Hadith 3149)
Saibah means that it is set free like a cow (i.e., left to roam freely).
If a person frees a slave woman or a male slave, then due to this act of emancipation, the one who set them free becomes the heir (warith) of the freed slave or slave woman. Thus, if the freed person passes away and has no blood relatives as heirs, then the emancipator will be their heir. This is because the Messenger’s command is: the wala’ (right of inheritance) of the freed person belongs to the one who set him free «(الولاء لمن اعتق. متفق عليه)» as has already been mentioned in [كتاب الفرائض ، باب 31 ، اثر رقم 3041-3054]. However, if any «تورعا» or «تنزها» does not accept the inheritance of their freed slave or slave woman, then this is recommended (mustahabb). The present chapter mentions this very matter.
