أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا عَبْدُ الْأَعْلَى، عَنْ مَعْمَرٍ، عَنْ الزُّهْرِيِّ، قَالَ: "إِذَا اجْتَمَعَ نَسَبَانِ، وُرِّثَ بِأَكْبَرِهِمَا، يَعْنِي الْمَجُوسَ".
Imam Zuhri, may Allah have mercy on him, said: When two lineages of the Magians are combined, the one who is greater will be the heir.
Brief Explanation
(Commentary on Hadith 3119)
If Magians (Majusis) reside under an Islamic government, then their inheritance will be distributed among them in such a way that the one who is closer in kinship (nasab) to the deceased will be entitled to a share of the inheritance. For example, if a man (Magian) has his mother or sister as his wife, and from her a son or daughter is born, then that son or daughter, being closer in kinship, will be the heirs. According to some scholars, other relatives will be excluded (mahjub), while according to others, both relatives will be given a share.
