يُونُسُ، عَنْ
عَامِرٍ، قَالَ: "كَانَ
مَسْرُوقٌ يُنَزِّلُ الْعَمَّةَ بِمَنْزِلَةِ الْأَبِ، إِذَا لَمْ يَكُنْ أَبٌ، وَالْخَالَةَ بِمَنْزِلَةِ الْأُمِّ، إِذَا لَمْ تَكُنْ أُمٌّ".
It is narrated from ‘Amir (Sha‘bi) رحمه الله that Masruq رحمه الله used to consider the paternal aunt, in the absence of the father, in the position of the father, and the maternal aunt, when there was no maternal uncle, in the position of the mother. That is, in the absence of the parents, he would give the paternal aunt and maternal aunt the share of inheritance of the father and mother.
