باب مِيرَاثِ الْغَرْقَى:Chapter on inheritance of those who drowned
Hadith 3078
حَدَّثَنَا يَحْيَى بْنُ حَسَّانَ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ يَحْيَى بْنِ عَتِيقٍ، قَالَ: قَرَأْتُ فِي بَعْضِ كُتُبِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي الْقَوْمِ يَقَعُ عَلَيْهِمْ الْبَيْتُ، لَا يُدْرَى أَيُّهُمَا مَاتَ قَبْلُ ؟ قَالَ: "لَا يُوَرَّثُ الْأَمْوَاتُ بَعْضُهُمْ مِنْ بَعْضٍ، وَيُوَرَّثُ الْأَحْيَاءُ مِنْ الْأَمْوَاتِ".
Yahya bin Atiq said: I have read in some writings of Umar bin Abdul Aziz, may Allah have mercy on him: Those people upon whom a house collapsed and it could not be known whose death occurred first, and none of the deceased will inherit from the other; rather, only the heirs of the deceased will be the inheritors.
