باب: الْوَلاَءُ لِلْكُبْرِ:Chapter: Wala' belongs to the eldest
Hadith 3061
حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ: "فِي أَخَوَيْنِ وَرِثَا مَوْلًى كَانَ أَعْتَقَهُ أَبُوهُمَا، فَمَاتَ أَحَدُهُمَا وَتَرَكَ وَلَدًا، قَالَ: كَانَ عَلِيٌّ، وَزَيْدٌ، وَعَبْدُ اللَّهِ، يَقُولُونَ: "الْوَلاءُ لِلْكَبِر".
It is narrated from Mughira that Ibrahim (may Allah have mercy on him) said regarding two brothers who inherited a slave whom their father had set free. One of the two brothers died and left behind his son. Ibrahim (may Allah have mercy on him) said: Sayyiduna Ali, Sayyiduna Zaid, and Sayyiduna Abdullah (may Allah be pleased with them) used to say: The right of wala’ is for the elder, that is, for the brother; there is nothing for the children of the brother.
