باب: الْوَلاَءُ لِلْكُبْرِ:Chapter: Wala' belongs to the eldest
Hadith 3059
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا شَرِيكٌ، عَنْ أَشْعَثَ، عَنْ ابْنِ سِيرِينَ، قَالَ: "تُوُفِّيَتْ فُكَيْهَةُ بِنْتُ سَمْعَانَ وَتَرَكَتْ ابْنَ أَخِيهَا لِأَبِيهَا، وَبَنِي بَنِي أَخِيهَا لِأَبِيهَا وَأُمِّهَا، فَوَرَّثَ عُمَرُ بَنِي أَخِيهَا لِأَبِيهَا".
Ibn Sirin, may Allah have mercy on him, said: Fakiha bint Sam'an passed away and left behind a paternal uncle's son and a real brother's grandson, so Sayyiduna Umar, may Allah be pleased with him, made the paternal uncle's sons heirs (because the grandson is a more distant relative).
