Abu Hani said: ‘Amir (al-Sha‘bi), may Allah have mercy on him, was asked about a child who is neither male nor female, neither having a complete male organ nor a complete female organ, and from whose private part urine and stool come out. What will be his share in inheritance? He replied: Half of his share will be as a male and half as a female.

Brief Explanation
(Commentary on Hadiths 3001 to 3004) This issue pertains to the khuntha mushkil (ambiguous intersex individual), and regarding this, it is better that if the person is a child, one should wait until puberty; perhaps the situation will become clear. And if it is absolutely necessary to distribute the inheritance immediately, then according to some scholars, half of the male share and half of the female share should be given to such a person.
