باب في ابْنِ الْمُلاَعَنَةِ:Chapter on the child of the woman who invoked the curse (li'an)
Hadith 2992
أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُبَيْدِ بْنِ عُمَيْرٍ، قَالَ: كَتَبْتُ إِلَى أَخٍ لِي مِنْ بَنِي زُرَيْقٍ أَسْأَلُهُ: لِمَنْ قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ابْنِ الْمُلَاعَنَةِ ؟ فَكَتَبَ إِلَيَّ: "أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّم: قَضَى بِهِ لِأُمِّهِ هِيَ بِمَنْزِلَةِ أُمِّهِ وَأَبِيهِ . وقَالَ سُفْيَانُ: الْمَالُ كُلُّهُ لِلْأُمِّ هِيَ بِمَنْزِلَةِ أَبِيهِ وَأُمِّهِ.
Abdullah bin Ubaid bin Umair said: I wrote to my brother among Banu Zuraiq asking what decision the Messenger of Allah (peace be upon him) had made regarding the son of the cursed woman (Ibn al-Mula'anah)? He replied that the Messenger of Allah (peace be upon him) decided in favor of the mother, because after li'an, the mother is both the mother and the father for the boy.
And Sufyan said: All the wealth will go to the mother because the "mother" will be in the position of both parents.
