Sunan ad-Darimi

Abu Ishaq said: I went to Shurayh with the issue of inheritance of a woman from my family, and with him were ‘Amir, Ibrahim, and Abdur Rahman bin Abdullah sitting. This woman left behind her husband, her mother, her paternal brother, and her grandfather. Judge Shurayh said: Does she have any sister? I said: No. So he said: Half for the husband, one-third (a third) for the mother. I waited, expecting that he would give me more of an answer, but when he did not give me any answer besides this, Ibrahim, ‘Amir, and Abdur Rahman bin Abdullah said: No one has come with a more difficult issue than the one you have brought. Abu Ishaq said: So I went to ‘Ubaidah al-Salmani, about whom it was said that in Kufa, no one knew the laws of inheritance better than ‘Ubaidah and Harith al-A‘war. ‘Ubaidah used to sit in the mosque, and when a case of inheritance came to (Judge) Shurayh in which a grandfather was present, he would refer it to ‘Ubaidah. So I asked him, and he said: If you wish, I will tell you the ruling of our master Abdullah bin Mas‘ud (may Allah be pleased with him) regarding this. He gave the husband three shares (i.e., half), from what remained he gave the mother one-third (a third), meaning one-sixth of the original estate (sudus), one share to the brother, and one share to the grandfather.
