Hadith 2924

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ الثَّوْرِيُّ، عَنْ أَبِي قَيْسٍ الْأَوْدِيِّ، عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ، قَالَ: جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ، وَإِلَى سَلْمَانَ بْنِ رَبِيعَةَ فَسَأَلَهُمَا عَنْ بِنْتٍ، وَبِنْتِ ابْنٍ، وَأُخْتٍ لِأُمٍّ وَأَبٍ، فَقَالَا: لِلِابْنَةِ النِّصْفُ، وَمَا بَقِيَ فَلِلْأُخْتِ، وَأْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا، فَجَاءَ الرَّجُلُ إِلَى عَبْدِ اللَّهِ، فَسَأَلَهُ عَنْ ذَلِكَ، فَقَالَ: لَقَدْ ضَلَلْتُ إِذًا، وَمَا أَنَا مِنْ الْمُهْتَدِينَ، وَإِنِّي أَقْضِي بِمَا"قَضَى بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لِلِابْنَةِ النِّصْفُ، وَلِابْنَةِ الِابْنِ السُّدُسُ، وَمَا بَقِيَ فَلِلْأُخْتِ".
Huzail bin Shurahbeel said: A man came to Abu Musa Ash’ari and Salman bin Rabee’ah and asked both of them about the inheritance shares of a daughter, a son’s daughter (granddaughter), and a full sister. Both of them said: The daughter will get half, and all the remainder is for the sister (because the presence of the daughter blocks the granddaughter). Then they said: Go to Sayyiduna Ibn Mas’ud (may Allah be pleased with him), perhaps he will support our opinion. So the man went to Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) and asked him for a ruling about this. He said: If I give such a ruling, I would go astray and would not be among the rightly guided. I only give the ruling as the Messenger of Allah (peace and blessings be upon him) gave: the daughter gets half, the granddaughter gets one-sixth, and whatever remains is for the sister.

Brief Explanation
(Commentary on Hadith 2923)

Sayyiduna Abu Musa and Sayyiduna Salman bin Rabi‘ah radi Allahu anhuma considered the granddaughter (son’s daughter) deprived (of inheritance) in the presence of the daughter, but when a similar case was brought before the Messenger of Allah sallallahu alayhi wa sallam, he sallallahu alayhi wa sallam, under «﴿فَإِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ﴾ [النساء : 176]», gave the granddaughter a sixth (sudus) to complete two-thirds, and what remained was given to the full sister. Sayyiduna Ibn Mas‘ud radi Allahu anhu had heard this decision, so he gave the same ruling.

From this hadith, it is established that the righteous predecessors, the Companions and the Followers (Tabi‘in), respected one another and accepted each other’s opinions, did not impose their own views, and in times of dispute and difference, followed the Sunnah of the Messenger and accepted his sallallahu alayhi wa sallam’s decision, «اللهم أرزقنا اتباع نبيك صلى اللّٰه عليه وسلم.»
