أَبُو نُعَيْمٍ، حَدَّثَنَا
زُهَيْرٌ، عَنْ
أَبِي إِسْحَاق، عَنْ
الْحَارِثِ الْأَعْوَرِ، قَالَ: أُتِيَ
عَبْدُ اللَّهِ فِي فَرِيضَةِ بَنِي عَمٍّ، أَحَدُهُمْ أَخٌ لِأُمٍّ، فَقَالَ: الْمَالُ أَجْمَعُ لِأَخِيهِ لِأُمِّه، فَأَنْزَلَهُ بِحِسَابِ، أَوْ بِمَنْزِلَةِ الْأَخِ مِنْ الْأَبِ وَالْأُمِّ، فَلَمَّا قَدِمَ
عَلِيٌّ، سَأَلْتُهُ عَنْهَا، وَأَخْبَرْتُهُ بِقَوْلِ عَبْدِ اللَّهِ، فَقَالَ: "يَرْحَمُهُ اللَّهُ، إِنْ كَانَ لَفَقِيهًا، أَمَّا أَنَا
فَلَمْ أَكُنْ لِأَزِيدَهُ عَلَى مَا فَرَضَ اللَّهُ لَهُ: سَهْمٌ السُّدُسُ، ثُمَّ يُقَاسِمُهُمْ كَرَجُلٍ مِنْهُمْ".
Harith al-A'war said: A case regarding the Banu 'Am (paternal cousins) was brought to Abdullah bin Mas'ud (may Allah be pleased with him), among whom there was a maternal brother. He said: All the wealth will go to the maternal (uterine) brother, as if he considered the maternal brother to be on the level of an heir by calculation or a real brother. Then when Ali (may Allah be pleased with him) arrived, I presented this issue before him and informed him of the decision of Abdullah bin Mas'ud (may Allah be pleased with him). He said: May Allah have mercy on him, he was indeed understanding (a jurist), but I will not give more in this case than what Allah Almighty has prescribed; for him is a sixth (one-sixth), then the remainder will be divided among them as if he were one of them (see details in the explanation below).
