باب في زَوْجٍ وَأَبَوَيْنِ وَامْرَأَةٍ وَأَبَوَيْنِ:Chapter on a husband, two parents, a wife, and two parents
Hadith 2910
حَدَّثَنَا حَجَّاجُ بْنُ مِنْهَالٍ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ حَجَّاجٍ، عَنْ الشَّعْبِيِّ، وَحَجَّاجٍ، عَنْ عَطَاءٍ، عَنْ ابْنِ عَبَّاسٍ: أَنَّهُمَا قَالَا فِي زَوْجٍ وَأَبَوَيْنِ: "لِلزَّوْجِ النِّصْفُ، وَلِلْأُمِّ ثُلُثُ جَمِيعِ الْمَالِ، وَمَا بَقِيَ فَلِلْأَبِ".
Ata (may Allah have mercy on him) and Sayyiduna Ibn Abbas (may Allah be pleased with them both) both said regarding the issue of the husband along with the parents: The husband gets half, and the mother gets one third of the entire wealth, and whatever remains is for the father.
