Hadith 2663

أَخْبَرَنَا يَعْلَى، حَدَّثَنَا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الشُّفْعَةِ إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا ؟ . قَالَ: "يُنْظَرُ بِهَا، وَإِنْ كَانَ صَاحِبُهَا غَائِبًا".
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said regarding pre-emption (shuf‘ah): "When both neighbors share the same path, the (neighbor) will be waited for on account of pre-emption, even if he is absent."

Brief Explanation
(Commentary on Hadith 2662)

Shuf‘ah refers to the right that is granted to a partner at the time of selling property, and that right is that the partner may acquire the property himself by paying the same price as the other buyer. This right is granted to both the partner and the neighbor, provided that the path of the neighbor and the seller is one and the same, as mentioned in the hadith, and this is what is correct.
