Hadith 2654

أَخْبَرَنَا إِسْحَاق بْنُ إِبْرَاهِيمَ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَخْبَرَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنْ مُحَمَّدِ بْنِ عِكْرِمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَبِيبَةَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ، قَالَ: كُنَّا نُكْرِي الْأَرْضَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمَا عَلَى السَّوَاقِي مِنَ الزَّرْعِ، وَبِمَا سَعِدَ مِنَ الْمَاءِ مِنْهَا،"فَنَهَانَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ، وَأَذِنَ لَنَا أَوْ قَالَ رَخَّصَ لَنَا فِي أَنْ نُكْرِيَهَا بِالذَّهَبِ وَالْوَرِقِ".
Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him) said: In the time of the Messenger of Allah (peace and blessings be upon him), we used to lease out land for a portion of the produce that grew on the edges of the water channels and that which water reached by itself, but the Messenger of Allah (peace and blessings be upon him) forbade us from this, and he permitted us to lease out land for gold or silver (i.e., for dirhams and dinars).

Brief Explanation
(In Explanation of Hadith 2653)
«السَّوَاقِي» and in some narrations, there is mention of «مَاذِيَانَاتُ» and «أَقْبَالُ الْجَدَاوِلِ».
The meaning of all these narrations is that the places where water flows, or the things that grow on both sides of the pathways, this hadith is prohibiting that form of musaqat and muzara‘ah (sharecropping and agricultural partnership) in which the produce and its quantity are unknown; for this reason, it has been prohibited.
However, if the land is leased in exchange for dirhams and dinars, gold or silver, then by consensus there is no harm in it, as permission has been granted in the aforementioned hadith.
