Hadith 2648

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا ابْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي الْمِنْهَالِ، قَالَ: سَمِعْتُ إِيَاسَ بْنَ عَبْدٍ الْمُزَنِيَّ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: لَا تَبِيعُوا الْمَاءَ: فَإِنِّي سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ"يَنْهَى عَنْ بَيْعِ الْمَاءِ" . وَقَالَ عَمْرُو بْنُ دِينَارٍ: لَا نَدْرِي أَيَّ مَاءٍ . قَالَ: يَقُولُ: لَا أَدْرِي مَاءً جَارِيًا أَوِ الْمَاءَ الْمُسْتَقَى ؟.
Sayyiduna Iyas bin Abd Muzani, may Allah be pleased with him, who was among the companions of the Prophet (peace and blessings be upon him), said: Do not sell water, for I heard the Prophet (peace and blessings be upon him) forbidding the selling of water.

Amr bin Dinar said: I do not know which type of water he forbade selling. He said: They say, I do not know whether he forbade selling flowing water or drinking water.

Brief Explanation
(Commentary on Hadith 2647)

In this hadith, there is a general prohibition on selling water, the details of which are as follows: Selling drinking water is not permissible; however, selling and purchasing water for irrigation or water drawn from a well to be carried away in a waterskin, etc., is permissible. It is not permissible to sell water from a well, pond, or spring for drinking or for watering animals; rather, the owner of the well should allow people to drink and to water their animals. Furthermore, there is no harm in selling purified water packed in bottles, because there are expenses involved in filtering, bottling, and supplying it, and it is permissible to take money in exchange for these services.

According to some scholars, the prohibition (nahi) in this hadith is of a tanzihi (discouraged but not strictly forbidden) nature, while others have said it is a tahrimi (strictly forbidden) prohibition, meaning that selling water in any circumstance is haram.
