Hadith 2643

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ هِشَامِ بْنِ عُرْوَةَ، قَالَ: أَخْبَرَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ رَافِعٍ: أَنَّ جَابِرَ بْنَ عَبْدِ اللَّهِ أَخْبَرَهُ: أَنَّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , قَالَ: "مَنْ أَحْيَا أَرْضًا مَيْتَةً فَلَهُ فِيهَا أَجْرٌ وَمَا أَكَلَتِ الْعَافِيَةُ مِنْهَا، فَلَهُ فِيهَا صَدَقَةٌ" . قَالَ أَبُو مُحَمَّدٍ: الْعَافِيَةُ: الطَّيْرُ وَغَيْرُ ذَلِكَ.
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) reported that the Messenger of Allah (peace and blessings be upon him) said: “Whoever revives barren, uninhabited land, there is reward for him in it, and whatever anyone eats from its produce, it is charity for him.” Imam Darimi (may Allah have mercy on him) said: ‘Aafiyah’ refers to birds and the like.

Brief Explanation
(Explanation of Hadith 2642)

«عافية عافي» is the feminine form, and in language it refers to every being with a soul that seeks sustenance, whether it be a human, a quadruped, or a bird. The meaning is that cultivating barren land also brings reward, and if any of the aforementioned creatures eat even a little from it, then this is charity (sadaqah) on behalf of the one who cultivated it.

It is mentioned in Tirmidhi: Whoever cultivates such land, it belongs to him.

From this, it is understood that there is no need for the ruler’s permission to cultivate barren land, though some scholars have said that it is not permissible to take possession of any land without permission.

And by «أَرْضًا مَيْتَةً» is meant that land in which there is neither agriculture, nor any building, nor is it owned by anyone.

And by cultivating is meant building a house, farming, or planting trees and orchards.

From this hadith, it is understood that in Islam, there is no concept of leaving land idle; it should be cultivated.

This is also a requirement for the stability of any country, and from this, the proof of individual ownership is also established.
