Hadith 2636

أَخْبَرَنَا مُعَاذُ بْنُ هَانِئٍ مِنْ أَهْلِ الْبَصْرَةِ، حَدَّثَنَا حَرْبُ بْنُ شَدَّادٍ، حَدَّثَنَا يَحْيَى بْنُ أَبِي كَثِيرٍ، حَدَّثَنَا أَبُو سَلَمَةَ، حَدَّثَنَا أَبُو هُرَيْرَةَ أَنَّهُ عَامَ فُتِحَتْ مَكَّةُ، قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: "إِنَّ اللَّهَ حَبَسَ عَنْ مَكَّةَ الْفِيلَ، وَسَلَّطَ عَلَيْهِمْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالْمُؤْمِنِينَ، أَلَا وَإِنَّهَا لَمْ تَحِلَّ لِأَحَدٍ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ بَعْدِي، أَلَا وَإِنَّهَا سَاعَتِي هَذِهِ حَرَامٌ لَا يُخْتَلَى خَلَاهَا، وَلَا يُعْضَدُ شَجَرُهَا وَلَا تُلْتَقَطُ سَاقِطَتُهَا إِلَّا لِمُنْشِدٍ".
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated that on the day of the conquest of Makkah, the Messenger of Allah (peace and blessings be upon him) stood up and said: "Allah Almighty prevented the elephants from entering Makkah, but He granted victory over it to His Messenger and the Muslims. Behold! Makkah was not made lawful for anyone before me (that is, fighting in Makkah), nor will it be made lawful for anyone after me. Listen! From this moment, Makkah is again sacred (forbidden for fighting); its thorns are not to be cut, its trees are not to be cut, and nothing dropped in it is to be picked up except by one who announces it, that is, the one who intends to return it to its owner—only he may pick up something found."

Brief Explanation
(Commentary on Hadith 2635)

In this hadith, the elephants refer to the army of Abraha, the ruler of Yemen, who came with elephants to demolish the Ka'bah in the year of the birth of the Messenger of Allah (sallallahu alayhi wa sallam), but Allah Ta'ala destroyed them through the Ababil birds.

From this hadith, it is understood that killing and bloodshed are prohibited in Makkah, to the extent that even its thorns and wild plants cannot be cut.

However, it is permissible to cut grass and plants that have been planted by humans.

Similarly, it is forbidden for both pilgrims (hajji) and non-pilgrims to pick up anything that has been dropped or lost by someone in that place, even if it is a slipper or something similar. However, it is permissible to pick it up and hand it over to the police or «مكتب خاص بالمفقودات».

Some people not only pick up lost items but even steal the belongings of the honored pilgrims (hujjaj kiram); this is a very grave sin for which there is a severe punishment.
