Hadith 2630

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ سُفْيَانَ، عَنْ أَبِي الزِّنَادِ، عَنْ الْأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "وَالَّذِي نَفْسِي بِيَدِهِ مَا عَلَى الْأَرْضِ مُؤْمِنٌ إِلا وأَنَا أَوْلَى النَّاسِ بِهِ، فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيَاعًا، فَلْأُدْعَ لَهُ، فَأَنَا مَوْلَاهُ، وَمَنْ تَرَكَ مَالًا، فَلِعَصَبَتِهِ مَنْ كَانَ" . قَالَ عَبْد اللَّهِ: ضَيَاعًا: يَعْنِي: عِيَالًا . وَقَالَ: فَلْأُدْعَ لَهُ، يَعْنِي: ادْعُونِي لَهُ أَقْضِ عَنْهُ.
Sayyiduna Abu Hurairah (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) said: "By the One in Whose hand is my soul, there is no believer on the face of the earth except that I am the closest to him (that is, I am his guardian and responsible for him). So whoever leaves behind a debt or children, I am to be called for him, I am his guarantor. And whoever leaves behind wealth, then that wealth is for his living heirs."

Imam Darimi (may Allah have mercy on him) said: «ضَيَاعًا» refers to children, and «فَلْأُدْعَ لَهُ» means that I should be called so that I may pay his debt.

Brief Explanation
(Commentary on Hadith 2629)

It is narrated in Bukhari, Muslim, Ibn Majah, and others that in the early days of Islam, when wealth was scarce, if a debtor passed away, the Messenger of Allah (sallallahu alayhi wa sallam) would not perform the funeral prayer over him. He would say to the Companions (radi Allahu anhum): “You perform the prayer over him.” Then, when Allah the Exalted opened the doors of conquest and wealth came into hand, the Prophet (sallallahu alayhi wa sallam) gave the command: “Whoever among the Muslims dies in debt, I will pay his debt, and if he leaves behind helpless children, I will take responsibility for their upbringing.” And how admirable is such a Prophet, the embodiment of mercy, the personification of kindness and compassion, that whatever wealth is left behind, it is for the heirs, but whatever debt is left behind, the Prophet (sallallahu alayhi wa sallam) himself would pay it. («اَللّٰهُمَّ آتِ نَبِيِّنَا مُحَمَّدًا الْوَسِيْلَةَ وَالْفَضِيْلَةَ وَابْعَثْهُ مَقَامًا مَحْمُوْدَا»).

From this hadith, it is understood that the Islamic state is responsible for providing for the needs of its citizens, to the extent that if any Muslim citizen dies in a state of debt and leaves behind no estate for the repayment of the debt, and no close relative guarantees the repayment, then in such a case, his debt will be paid from the public treasury (bayt al-mal) of the Islamic state.

This hadith also shows the love and compassion of the Noble Prophet (sallallahu alayhi wa sallam) for the disabled, the helpless, and the debtors of his ummah, and how merciful, sympathetic, and caring he was towards them. The heads of state should be just like this with their subjects. (Mubarakpuri rahimahullah).
