Hadith 2619

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ ابْنِ أَبِي نَجِيحٍ، عَنْ عَبْدِ اللَّهِ بْنِ كَثِيرٍ، عَنْ أَبِي الْمِنْهَالِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: قَدِمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ وَهُمْ يُسْلِفُونَ فِي الثِّمَارِ فِي سَنَتَيْنِ وَثَلَاثٍ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "أسْلِّفُوا فِي الثِّمَارِ: فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ" . وَقَدْ كَانَ سُفْيَانُ يَذْكُرُهُ زَمَانًا إِلَى أَجَلٍ مَعْلُومٍ، ثُمَّ شَكَّكَهُ عَبَّادُ بْنُ كَثِيرٍ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: The Messenger of Allah (peace and blessings be upon him) came to Madinah at a time when the people of Madinah used to pay the price of fruits in advance for two or three years. So the Messenger of Allah (peace and blessings be upon him) said: "When paying the price of fruits in advance, make sure the measure, weight, and quantity are known and specified."

Sufyan (may Allah have mercy on him) used to mention for a time «إلی أجل معلوم» (that is, the period should also be specified), then Abdullah bin Kathir caused him to doubt about it.

Brief Explanation
(Commentary on Hadith 2618)

The root and meaning of "bay‘ salaf" and "salam" are the same.
Salaf refers to that sale in which one person gives cash money to another and says: after such-and-such period, you must give me, in exchange for this money, such-and-such quantity of grain or rice of such-and-such type. In common parlance, this is called "bad-hani" (advance purchase), and this sale is unanimously permissible. Some people have said: the word "salaf" is from the language of the people of Iraq, and "salam" is from the people of Hijaz; the meaning of both is the same. "Kayl" and "wazan" refer to measuring by volume and weight.

In this hadith, the form of salaf is as follows: for example, someone says, "For one hundred rupees, I will receive such-and-such weight of grain from you exactly one or two years from today." After agreeing on this, the buyer pays the one hundred rupees immediately. This is a sale of salam or salaf.

Now, upon completion of the period, the seller must deliver the specified weight of grain to the buyer; this is permissible.

Hafiz Ibn Hajar rahimahullah said: There is consensus on this matter that in a sale of salam, for those things that are measured by volume or weight, specifying the weight is necessary, and for those things that are counted by number, specifying the number is necessary.

From the mentioned hadith, it is understood that this type of transaction was commonly practiced in Madinah, and in reality, farmers and craftsmen need advance capital, without which they cannot do anything.
