Hadith 2601

أَخْبَرَنَا الْحَكَمُ بْنُ الْمُبَارَكِ، عَنْ مَالِكٍ، قِرَاءَةً عَلَيْهِ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ: مَوْلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: اسْتَسْلَفَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَكْرًا، فَجَاءَتْ إِبِلٌ مِنْ إِبِلِ الصَّدَقَةِ . قَالَ أَبُو رَافِعٍ: فَأَمَرَنِي أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ، فَقُلْتُ: لَمْ أَجِدْ فِي الْإِبِلِ إِلَّا جَمَلًا خِيَارًا رَبَاعِيًا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "أَعْطِهِ إِيَّاهُ، فَإِنَّ خَيْرَ النَّاسِ أَحْسَنُهُمْ قَضَاءً" . قَالَ عَبْد اللَّهِ: هَذَا يُقَوِّي قَوْلَ مَنْ يَقُولُ: الْحَيَوَانُ بِالْحَيَوَانِ.
Sayyiduna Abu Rafi’ (may Allah be pleased with him), the freed slave of the Messenger of Allah (peace and blessings be upon him), said: The Messenger of Allah (peace and blessings be upon him) took a young camel as a loan. When the camels for charity (zakat) arrived, Sayyiduna Abu Rafi’ (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) ordered me to return the man’s camel. I said: I have not found among these camels except a best four-toothed (mature) camel. The Messenger of Allah (peace and blessings be upon him) said: “Give him that best four-toothed camel; the best people are those who repay debts well.”
Imam Darimi (may Allah have mercy on him) said: This hadith strengthens the statement of those who consider the sale of an animal in exchange for another animal to be permissible.

Brief Explanation
(Commentary on Hadith 2600)

In this hadith, “to repay well” means to return something better than what was borrowed, without any prior condition. If one gives back something superior or more than the loaned amount, it is recommended (mustahabb), and accepting it is permissible, but it is not permissible if it is stipulated as a condition, because that would be outright usury (riba).

This hadith also shows that it is permissible to take a loan in the form of livestock.

This is the view of many Imams and Tabi‘in.

According to Imam Abu Hanifah rahimahullah, this is not permissible, and the aforementioned hadith is an argument against his position.
