Hadith 2594

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، عَنْ الْأَوْزَاعِيِّ، عَنْ ابْنِ شِهَابٍ، عَنْ سَالِمٍ، عَنْ ابْنِ عُمَرَ، عَنْ زَيْدِ بْنِ ثَابِتٍ، قَالَ: "رَخَّصَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي بَيْعِ الْعَرَايَا بِالتَّمْرِ وَالرُّطَبِ، وَلَمْ يُرَخِّصْ فِي غَيْرِ ذَلِكَ".
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) permitted the sale of ‘Araya in exchange for fresh or dry dates, and did not permit it in any other (form).

Brief Explanation
(Explanation of Hadith 2593)

‘Araya’ is the plural of ‘ariyyah’, and it refers to such a sale in which a person gives two or three trees from his orchard to a poor person, and then, considering it inappropriate for that person to come repeatedly to the orchard, he buys the fruit of those trees from him in exchange for dried dates. It is necessary that this fruit be less than five wasq.

Maulana Safiur Rahman Mubarakpuri rahimahullah writes: It should be noted that the Arabs, during times of famine and drought, used to give the fruits of certain trees in their orchards to the poor and needy as charity, excluding the rest of the orchard, saying, “The dates of such-and-such tree are yours.” The dates given in this way as a gift are called ‘ariyyah’. The poor would go to these orchards to eat the fruit of these date trees, which would cause inconvenience to the owner of the orchard. It would also happen that, due to their poverty and need, the poor could not wait for the fruit to ripen, so they would sell their share of the fruit while it was still on the tree, and in exchange, they would take dried dates (i.e., exchanging fresh for dried), and the owners of the orchards would be relieved from the daily comings and goings.
This is exactly the same form as the sale of muzabana.

When the Messenger of Allah sallallahu alayhi wa sallam prohibited the sale of muzabana, then, in order to fulfill the need and necessity, he permitted the sale of ‘araya’ on the condition that the fruit on the trees be estimated and, in exchange, an equal measure of dates be given, provided it is less than five wasq.
There are other forms of this as well, which can be seen in the books of commentary.

In any case, from this hadith, the best example of Islam’s care for the poor, the comfort of the needy, and sympathy for all comes to light. The Hanafis, by analogy with muzabana, have denied the permissibility and lawfulness of the sale of ‘ariyyah’, which is a rejection of authentic ahadith.
In most places in the books of hadith where the prohibition of muzabana is mentioned, in the adjoining chapters, the permissibility of ‘araya’ is also mentioned. Therefore, ‘ariyyah’ is permissible for the poor and needy in a specific quantity.
