Hadith 2585

أَخْبَرَنَا عُثْمَانُ بْنُ مُحَمَّدٍ، حَدَّثَنَا هُشَيْمٌ، حَدَّثَنَا ابْنُ أَبِي لَيْلَى، عَنْ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ أَبِيهِ، عَنْ عَبْدِ اللَّهِ، قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , يَقُولُ: "الْبَيِّعَانِ إِذَا اخْتَلَفَا وَالْمَبيعُ قَائِمٌ بِعَيْنِهِ، وَلَيْسَ بَيْنَهُمَا بَيِّنَةٌ، فَالْقَوْلُ مَا قَالَ الْبَائِعُ، أَوْ يَتَرَادَّانِ الْبَيْعَ".
Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) say: “When the seller and the buyer (the one who sells and the one who buys) have a dispute and the sold item (i.e., the goods) is still present as it was, and there is no evidence (or witness) between them, then the statement of the (owner) seller will be considered valid, or both of them should leave (cancel) the transaction.”

Brief Explanation

If there is a dispute between the seller and the buyer regarding the price or the nature of the goods, and neither of them has a clear proof or witness, then the statement of the seller will be accepted, or both parties will cancel the transaction.
