Brief Explanation
(Explanation of Hadith 2578) «لَايَحْتَكَر:» is derived from ihtikar, meaning to withhold grain, not to sell it, in anticipation that the price will rise and then it will be sold, while the public is in severe need of it, and the seller is not in need of it. And by «خَاطِءٌ» is meant a disobedient, sinful, wrongdoer. In this hadith, hoarding is prohibited, in such a way that a person buys something with the intention that when the prices increase, he will sell it at that time, even though there is great demand for it among the public. The words of the hadith are general, but the majority (jumhur) have taken from it only those things which are food and drink for humans and animals; other items are exempted from this prohibition. Hoarding in such a manner is undoubtedly haram (forbidden) when it creates a shortage of daily necessities, and those who possess these items hide them away; hoarding is haram for traders. If a landowner withholds his own produce, then there is leeway for him, but when the shortage of grain becomes severe, then it will not be permissible for him to withhold the grain either.
