Hadith 2538

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الْمَجِيدِ، حَدَّثَنَا مَالِكٌ، عَنْ أَبِي النَّضْرِ: أَنَّ أَبَا مُرَّةَ مَوْلَى عَقِيلِ بْنِ أَبِي طَالِبٍ أَخْبَرَهُ أَنَّهُ سَمِعَ أُمَّ هَانِئٍ بِنْتَ أَبِي طَالِبٍ تُحَدِّثُ أَنَّهَا ذَهَبَتْ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ الْفَتْحِ، فَقَالَتْ: يَا رَسُولَ اللَّهِ، زَعَمَ ابْنُ أُمِّي أَنَّهُ قَاتِلٌ رَجُلًا أَجَرْتُهُ فَلانَ بْنُ هُبَيْرَةَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "قَدْ أَجَرْنَا مَنْ أَجَرْتِ يَا أُمَّ هَانِئٍ".
Abu Murrah, the freed slave of Aqeel bin Abi Talib, said: He heard from Sayyida Umm Hani bint Abi Talib (may Allah be pleased with her): She narrates that she went to the Messenger of Allah (peace and blessings be upon him) in the year of the conquest of Makkah and said: O Messenger of Allah (peace and blessings be upon him)! My brother from my mother’s side (Sayyidina Ali bin Abi Talib, may Allah be pleased with him) thinks that he will kill the son of Hubayrah whom I have granted protection. The Messenger of Allah (peace and blessings be upon him) said: “O Umm Hani! Whoever you have granted protection, we have also granted protection.” (That is, Sayyidina Ali, may Allah be pleased with him, is not permitted to kill him.)

Brief Explanation
(Commentary on Hadith 2537)

Ijara: It means granting protection.

Sayyidah Umm Hani radi Allahu anha was the paternal cousin of the Messenger of Allah sallallahu alayhi wa sallam and the real sister of Sayyiduna Ali radi Allahu anhu.

She had granted protection to a relative of her husband, Hubayrah ibn Abi Wahb, who had died in a state of disbelief, out of loyalty to her husband. However, Sayyiduna Ali radi Allahu anhu wanted to kill him because he was a polytheist, but Sayyidah Umm Hani radi Allahu anha had granted him protection after the conquest of Makkah. Therefore, the Messenger of Allah sallallahu alayhi wa sallam upheld her granting of protection.

From this, it is understood that even the lowest-ranking Muslim, whether man or woman, can grant protection to a non-Muslim, and everyone must abide by this ruling.
