Hadith 2483

أَخْبَرَنَا هَاشِمُ بْنُ الْقَاسِمِ، حَدَّثَنَا شُعْبَةُ، عَنْ النُّعْمَانِ بْنِ سَالِمٍ، قَالَ: سَمِعْتُ أَوْسَ بْنَ أَبِي أَوْسٍ الثَّقَفِيَّ، قَالَ: أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي وَفْدِ ثَقِيفٍ، قَالَ: وَكُنْتُ فِي أَسْفَلِ الْقُبَّةِ لَيْسَ فِيهَا أَحَدٌ إِلا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَائِمٌ إِذْ أَتَاهُ رَجُلٌ فَسَارَّهُ، فَقَالَ: "اذْهَبْ فَاقْتُلْهُ"، ثُمَّ قَالَ: "أَلَيْسَ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ ؟". قَالَ شُعْبَةُ: وَأَشُكُّ مُحَمَّدًا رَسُولُ اللَّهِ ؟ . قَالَ: بَلَى . قَالَ: "إِنِّي أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا: لَا إِلَهَ إِلَّا اللَّهُ، فَإِذَا قَالُوهَا، حَرُمَتْ عَلَيَّ دِمَاؤُهُمْ وَأَمْوَالُهُمْ إِلا بِحَقِّهَا" . قَالَ: وَهُوَ الَّذِي قَتَلَ أَبَا مَسْعُودٍ . قَالَ: وَمَا مَاتَ حَتَّى قَتَلَ خَيْرَ إِنْسَانٍ بِالطَّائِفِ.
Sayyiduna Aws bin Abi Aws Thaqafi (may Allah be pleased with him) said: I came to the service of the Messenger of Allah (peace and blessings be upon him) with the delegation of Banu Thaqif, and I was in one corner of the tent in which there was no one except the Messenger of Allah (peace and blessings be upon him). The Prophet (peace and blessings be upon him) was sleeping, when suddenly a companion came to him and whispered. The Prophet (peace and blessings be upon him) said: "Go and kill him." He said: Then the Prophet (peace and blessings be upon him) said: "Does he not testify that there is no god but Allah?" Shu’bah said: I am unsure whether he mentioned the testimony of Muhammad (peace and blessings be upon him) or not. They said: Yes (he testifies to it). He said: "I have been commanded to fight the people until they say La ilaha illallah, and when they say it, then their blood and wealth are protected from me except by the right of Islam (i.e., legal punishment or retribution), and their reckoning is with Allah." The narrator said: This person had killed Abu Mas’ud, and he did not die until the best man of Ta’if had passed away.

Brief Explanation
(Commentary on Hadith 2482)

From this hadith, it is understood that whoever says "La ilaha illallah Muhammadur Rasulullah," his wealth and his life become protected; now, due to being an enemy of Islam, he can neither be killed nor can his wealth and possessions be taken by force, except by the right of Islam. That is, in cases of legal punishment (hadd) or retribution (qisas), life for life, and from wealth, zakat and charity, etc., because by uttering this testimony, he has entered into the fold of Muslims, and it is forbidden for one Muslim to kill another Muslim or to usurp his wealth.

As is narrated in: «أَلَا إِنَّ دِمَاءَ هُمْ وَأَمْوَالَهُمْ حَرَامٌ عَلَيْكُمْ كَحُرْمَةِ يَوْمِكُمْ هٰذَا فِيْ بَلَدِكُمْ هٰذَا فِيْ سَهْرِكُمْ هٰذَا ..... (أو كما قال عليه السلام)»
