Hadith 2425

أَخْبَرَنَا يُونُسُ بْنُ مُحَمَّدٍ، حَدَّثَنَا جَرِيرٌ يَعْنِي: ابْنَ حَازِمٍ، قَالَ: سَمِعْتُ عَبْدَ الْمَلِكِ بْنَ عُمَيْرٍ، حَدَّثَنِي إِيَادُ بْنُ لَقِيطٍ، عَنْ أَبِي رِمْثَةَ، قَالَ: قَدِمْتُ الْمَدِينَةَ وَمَعِيَ ابْنٌ لِي، وَلَمْ نَكُنْ رَأَيْنَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . فَأَتَيْتُهُ، فَخَرَجَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَعَلَيْهِ ثَوْبَانِ أَخْضَرَانِ . فَلَمَّا رَأَيْتُهُ عَرَفْتُهُ بِالصِّفَةِ، فَأَتَيْتُهُ، فَقَالَ: "مَنْ هَذَا الَّذِي مَعَكَ ؟". قُلْتُ: ابْنِي وَرَبِّ الْكَعْبَةِ، فَقَالَ: "ابْنُكَ ؟"، فَقُلْتُ: أَشْهَدُ بِهِ . قَالَ: "فَإِنَّ ابْنَكَ هَذَا لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ".
Sayyiduna Abu Rimthah (may Allah be pleased with him) said: I came to Madinah with my son. We had not seen the Messenger of Allah (peace and blessings be upon him). I went to him, and he came out wearing two garments. When I saw him, I recognized him by his sign. When I approached him, he said: "Who is this with you?" I said: By the Lord of the Ka'bah, this is my son. He said: "Is he really your son?" I replied: Yes, I bear witness to it (or you be a witness, this is my son). The Prophet (peace and blessings be upon him) said: "Indeed, your son will not be responsible for your sins and crimes, nor will you be responsible for his sins and crimes."

Brief Explanation
(Commentary on Hadith 2424)

In «أَشْهَدُ بِهِ», there is a possibility that the verb form is one of request, and its meaning would be: "You bear witness that this is my son from my own loins." There is also the possibility that the verb form is first person, and he is affirming: "Indeed, this is my son." The actual intent behind this was that, in the Age of Ignorance (Jahiliyyah), the guarantee for crimes would be imposed in such a way that the son would be held responsible in place of the father, and the father in place of the son. It was towards this principle that Sayyiduna Abu Rimthah radi Allahu anhu was alluding, and for this reason, the Messenger of Allah sallallahu alayhi wa sallam refuted his thought and perspective, and said that he (the son) is not responsible for your crimes and sins, nor are you answerable for his crimes.

That is, if a crime is committed or perpetrated by him, then you will not be apprehended for accountability as a consequence, nor will its guarantee be upon your head. Similarly, conversely, if he commits a crime, then the burden of that crime will fall upon him, and you will not be questioned regarding his crime. As the statement of Allah, the Exalted, is: «﴿وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾ [الإسراء : 15]» — that is, no bearer of burden will bear the burden of another. Each will have to bear his own burden; whoever does (an act), will bear its consequences.
