Sayyiduna Wa'il bin Hujr (may Allah be pleased with him) said: I was present with the Prophet (peace and blessings of Allah be upon him) when a murderer, tied with a strap, was brought to him. The Messenger of Allah (peace and blessings of Allah be upon him) said to the heir of the slain: "Will you pardon this murderer?" He replied: No. The Prophet (peace and blessings of Allah be upon him) said: "Then will you accept blood money?" He replied: No. The Prophet (peace and blessings of Allah be upon him) said: "Then will you kill him?" He said: Yes, I will kill him. The Messenger of Allah (peace and blessings of Allah be upon him) said: "If you pardon this murderer, he will bear your and your slain (brother's) sin." Wa'il said: So that companion let the murderer go, and I was watching as the murderer was pulling his strap and leaving; he pardoned the murderer.

Brief Explanation
(Commentary on Hadith 2395) From this hadith, it is understood that in the case of intentional murder (qatl-e-amd), the heirs of the murdered person have the choice to demand the killing of the murderer in retribution (qisas), to pardon him, or to accept blood money (diyah), as has been mentioned in (2388).
Imam Nawawi rahimahullah said: From this hadith, it is understood that it is permissible to bind criminals and present them before the judge, that the plaintiff should be given a response from the defendant first, that if the defendant confesses, there is no need for witnesses, that the judge should encourage and request the heirs of the murdered person to pardon, and that such pardon is valid, that even after the case has been referred back, accepting blood money (diyah) is permissible, and that the murderer may be handed over to the heirs for retribution (qisas). All these rulings are derived from the aforementioned hadith.
