Hadith 2392

أَخْبَرَنَا عَفَّانُ، حَدَّثَنَا هَمَّامٌ، حَدَّثَنَا قَتَادَةُ، عَنْ أَنَسٍ: أَنَّ جَارِيَةً رُضَّ رَأْسُهَا بَيْنَ حَجَرَيْنِ، فَقِيلَ لَهَا: مَنْ فَعَلَ بِكِ هَذَا أَفُلَانٌ، أَفُلَانٌ ؟ حَتَّى سُمِّيَ الْيَهُودِيُّ، فَأَوْمَأَتْ بِرَأْسِهَا، فَبُعِثَ إِلَيْهِ فَجِيءَ بِهِ، فَاعْتَرَفَ، "فَأَمَرَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرُضَّ رَأْسُهُ بَيْنَ حَجَرَيْنِ".
It is narrated from Sayyiduna Anas (may Allah be pleased with him) that the head of a girl was crushed between two stones. She was asked: "Did so-and-so or so-and-so do this to you?" Until the name of a Jew was mentioned, and she affirmed it by nodding her head. So he was summoned and he confessed, therefore the Messenger of Allah (peace and blessings be upon him) ordered, and his head was also crushed between two stones.

Brief Explanation
(Commentary on Hadith 2391)

This murdered girl was an Ansari woman and was wearing gold bangles. This Jew, out of greed, placed the innocent girl's head between two stones and crushed it, then took off the bangles and went away. Consequently, the girl was brought to the Messenger of Allah (sallallahu alayhi wa sallam) in such a state that there was still some life left in her, and she identified the Jew. Therefore, after his confession, the head of this murderer and oppressor was also placed between two stones and crushed in the same manner.

Two things are learned from this: firstly, that a man will be killed in retribution for a woman; secondly, that just as he killed, he will also be killed in the same manner.

This is the position of Imam Malik, Shafi’i, and Ahmad (rahimahumullah), as is mentioned in this hadith.

Imam Abu Hanifah (rahimahullah) said: There is no need for equivalence in the method of killing; rather, he should be killed by sword or gun. He responds to this hadith by saying that this was merely a political and disciplinary punishment.
