Hadith 2381

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ، حَدَّثَنِي اللَّيْثُ، حَدَّثَنِي يُونُسُ، عَنْ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، عَنِ ابْنِ عَبَّاسٍ: أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ لِأَبِي بَكْرٍ: "لَا تُقْسِمْ" . قَالَ أَبُو مُحَمَّدٍ: الْحَدِيثُ فِيهِ طُولٌ.
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said to Sayyiduna Abu Bakr (may Allah be pleased with him): "Do not swear an oath." Imam Darimi (may Allah have mercy on him) said: This is a lengthy hadith.

Brief Explanation
(Commentary on Hadith 2380)

One way of swearing an oath is as follows: someone says, "By Allah, you said such and such," or "By Tallaah," or "By the Lord of the Ka'bah." These and other similar expressions do not contain the explicit word for oath (qasam), yet still, the oath becomes binding.

The second way is that someone says: «أقسمت باللّٰه» or as it is in the Noble Qur'an: «﴿لَا أُقْسِمُ بِهَذَا الْبَلَدِ﴾ وغيرها», meaning someone says, "I swear by Allah..." In this way as well, the oath becomes binding, and the one who swears must fulfill it, or else offer expiation (kaffarah).

The aforementioned hadith has already been mentioned previously, but Imam Darimi rahimahullah did not mention the word for oath in it. In Bukhari and other collections, it is narrated that when Sayyiduna Abu Bakr radi Allahu anhu interpreted the dream, the Prophet sallallahu alayhi wa sallam said, "Some of it you interpreted correctly, and some of it incorrectly." At that time, Sayyiduna Abu Bakr radi Allahu anhu said: «أقسمت عليك يا رسول اللّٰه .....» "O Messenger of Allah! I adjure you by Allah, what mistake did I make?"

At that time, the Messenger of Allah sallallahu alayhi wa sallam said: «لا تقسم» "Do not swear an oath."

This is the relevant point of evidence, and from this it is understood that by using the word for oath, the oath becomes binding.
