Hadith 2339

أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا اللَّيْثُ، عَنْ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، عَنْ عَائِشَةَ: أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ، فَقَالُوا: مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟، قَالُوا: وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ فَكَلَّمَهُ أُسَامَةُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ؟"ثُمَّ قَامَ فَاخْتَطَبَ، فَقَالَ: "إِنَّمَا هَلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهُمُ الشَّرِيفُ، تَرَكُوهُ، وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ، أَقَامُوا عَلَيْهِ الْحَدَّ، وَايْمُ اللَّهِ، لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ، لَقَطَعْتُ يَدَهَا".
It is narrated from Sayyida Aisha (may Allah be pleased with her) that the case of a woman from the Makhzum tribe who had committed theft became significant among the Quraysh, and they said: Who will speak to the Messenger of Allah (peace and blessings be upon him) about this matter? Then they said: Who can dare to do this except Usama bin Zaid (may Allah be pleased with him)? He is the beloved of the Messenger of Allah (peace and blessings be upon him). So Usama (may Allah be pleased with him) spoke to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Are you interceding regarding one of the limits set by Allah?" Then the Messenger of Allah (peace and blessings be upon him) stood up and addressed the people, saying: "O people! Those before you were destroyed because when a noble person among them committed theft, they would let him go, but if a weak person committed theft, they would carry out the punishment on him. By Allah, if Fatimah, the daughter of Muhammad (peace and blessings be upon him), had committed theft, I would have surely cut off her hand."

Brief Explanation
(Commentary on Hadith 2338)

This hadith is a clear proof that it is not permissible to intercede in matters of the prescribed punishments (hudud). Even though Sayyiduna Usamah radi Allahu anhu was beloved and dear to the Messenger of Allah sallallahu alayhi wa sallam, the Prophet sallallahu alayhi wa sallam addressed him in stern words, saying: “Are you interceding regarding one of Allah’s prescribed punishments?” and rejected his intercession. Not only this, but he also delivered a sermon and openly declared that the cause of destruction and ruin of the previous nations was that they would enforce the prescribed punishment on whomever they wished and let go whomever they wished.

May we be sacrificed for the Prophet of Mercy, the Prophet of Justice and Fairness! He said: “Even if my most beloved youngest daughter Fatimah were to steal, I would cut off her hand as well.”

Subhan Allah! What an example of obedience and adherence to the commands of the Lord! Although it was impossible for Sayyidah Fatimah az-Zahra radi Allahu anha to commit such an act, the Prophet sallallahu alayhi wa sallam gave this example and said that even if she were to do so, he would have no hesitation in carrying out Allah’s command.

«صلى اللّٰه على محمد وعلى آله وصحبه وسلم تسليمًا كثيرًا كثيرا.»
